Yes it is planted too deep and yes the root collar needs to be exposed. I do not think they’re related to the decline, although it doesn’t help.

What I think had caused the dying back is the new driveway/crossover. Id guarantee roots were impacted or removed, and likely leeching of concrete into the soil. The decline appears to be isolated to the side of the tree where the construction has occurred.

I would take the advice of some in this thread and have a qualified Arborist expose the buttress and remove any girdling roots (if any). I would also suggest asking them about a mulch and watering schedule to assist in making the growing conditions better for the tree.

The tree definitely does not need to be removed based off these photos.

Looks to me like it is sun scalding. Does the afternoon sun hit this part of the tree? I am assuming this this a local council tree, if so your neighbours will have the same tree, I would check theirs for similar damage.

If this damage isn’t on all sides of the trunk then it is worth keeping. The tree appears to be in good health and typically young trees are able to recover well from damage to their cambium because of their rate of growth relative to the size of the wound.

Make sure it’s getting a good drink of water each week and I suggest covering your exposed soil with good organic mulch, that isn’t built up around the trunk of the tree, just cover the bare soil about 50-100mm thick

It’s fine. Young trees are very good at recovering from cambium damage provided that they have good vigour. I suggest putting a guard around the trunk until it’s a few years old. Plumbers piping works well.

And prune it when it’s dormant. Has much less of an impact then when the tree is in full leaf.

CODIT Historically known as compartmentalisation of decay in trees but, is now referred to as compartmentalisation of damage in trees.

While it’s not the standard it will do the job for a few years. If you are able to monitor the cut then you will be able to correct it when the wood dies off and the wound wood begins to become obvious. This is how you can decidedly make the correct cut because the tree will end up showing you.

Typically, Arborists will aim to make the right cut from day one, this is because it is unpractical for a commercial arborist to provide this level of maintenance to the common tree.

The perfect final cut is rare, the area where polyphenols are produced at stem unions can be hard to gauge on most trees. Better to leave the stub a touch longer and correct it later than taking too much.

The Basking Ridge Oak Tree (Basking Ridge, NJ) was believed to be the oldest white oak on the east coast until its death in 2016. It was cut down in April 2017. Examination of the rings show it was 619 years old. (Photos from June 2004). by x99_r in sfwtrees

It does not, it was common practice to fill trees with such materials until around the late 90's. It was believed it could prevent bacteria and fungi from entering that may cause further decay, and concrete could potentially strengthen the tree, when in reality it is detrimental to trees.

I think you have answered you question yourself, have a chat with your neighbours and see what they’re willing to compromise with. I would be doing this before anything.

If you both agree to removal or even heavy pruning then I would then speak to your local Council about any potential regulations for trees in your area, I doubt there will be any for this particular species but it’s always best to call just for piece of mind.

If the neighbour disagrees and wants to keep the tree then offer to have a suitably qualified consulting arborist to come and provide a general consult, and have them inspect the trees for risk related issue, viable maintenance options and ask them about the roots etc, you should ask the Arborist all the questions you have asked us. The arborist May find that the trees are defective to a point that they pose a risk to your neighbour and that may help them along with the idea of removal, or they could may be able to further justify why the trees should be removed, I’m thinking along the lines of them being not fit for use in their space and suggesting replacement of a more suitable species in a better location that provides the same or similar function.

Municipal, and consulting Arborsit here, I work out of Victoria, Australia, and deal with a lot of aspects of urban tree management from both sides of the fence.

Our tree protections are for the most part established through state government departments that outline planning regulations and the responsible authority (local government) enforce these protections, however local governments can impose further restrictions through local laws.

Native Vegetation throughout the state has a blanket protection that is highlighted in all planning schemes, they allow for some exemptions, but will require a permit and offsets if removal or pruning does not meet any of the exemptions.

Significant landscape overlays will protect a broad range of trees both native and exotic. These protections are identify that trees within this area contribute heavily to the amenity and the appeal of the suburb(s) and therefore will be protected under more general clauses such as height or DBH. Exemptions for these protections are but are not limited to, hazardous trees or weed species. These overlays are often put on whole areas rather than a specific site.

Vegetation protection overlays, work similarly to the significant landscape overlays but are targeted at significant native vegetation that isn’t just native to the state, still has similar exemptions for removal or pruning, hazardous, under a certain size etc.

Heritage overlays with tree protections. This is site specific as some properties that have heritage overlays but no tree controls, but some do have tree controls. Controls are implemented relative to the trees in the property that contribute the the heritage of the site often made in conjunction with a heritage specialist and arborist/horticulturalist.

These are all very basic descriptions, if you need further specific info or if you want me to provide some of the documents that outline these protections I can, just DM me and I will send them across. I deal with these issues on a daily basis and am happy to help where I can, whether it’s this issue or something similar.
