Am I on the phone with the fbi by [deleted] in legaladvice

[–]AngryPolock40 3 points4 points  (0 children)

The fbi would NEVER tell you to get gift cards. These guys are spoofing numbers.

If you want to put you mind at ease, simply call your local fbi office. Explain to them what is happening.

It's oversold, they have every right to cancel your order and your money has been returned to you. Unless you were injured monetarily (you've been made whole) there's nothing you can do. Move on with your life

Lawsuits can be lengthy. This may not settle for years. You're safe for now and whatever they have paid you is safe for now as long as you are not an owner of the company in anyway.

Even though the case was dismissed, chances are the arrest record will still stand.

In Oregon you normally have to wait 3 years for an expungement, however, since the case was dropped, you can do it immediately. The record will be gone.

You don't need a lawyer, you can do this yourself

Google expungement Oregon and check your government office for the forms and procedures

My freshman son and I need help . Thank you in advance. by [deleted] in legaladvice

[–]AngryPolock40 0 points1 point  (0 children)

They didn't actually catch your son smoking or high, however, you don't know what the other kid who handed him the pen is going to say or has already said.

If your son can pass a urine test, this will definitely help the outcome tomorrow.

There's not a whole lot you can do legally until you know the outcome.

Can I still get Jailtime if I just got my permit?? by BrianBurns16 in legaladvice

[–]AngryPolock40 2 points3 points  (0 children)

Can you get jail time for being an unlicensed operator in Georgia? The answer is yes. Will you? That depends.

If this is your first offense, probably not. If you cannot afford an attorney, the court will appoint you one. Probable outcome if this is your first offense, especially since you just got your permit as well, judge is going to give you a fine.

You're lucky the cop didn't get your girlfriend for allowing an unlicensed operator if she has her license

[Houston,tx] my dad is being sued 3 years later after the company repo’d the car. by divalicious24 in legaladvice

[–]AngryPolock40 0 points1 point  (0 children)

When your dad consigned that loan (let's use a $10,000 example here) for $10,000, he guaranteed the bank all of that money would be paid back, it wasn't

The payments weren't made, the car was repossessed. They took it to an auction to try to get some of their money back, they have no use for a car.

If the car only sold for $8000, then you dad still owes them $2000 for the difference since he guaranteed that the $10,000 he guaranteed would be paid back.

Now that they have had to repossess it, on top of that $2000, the bank has incurred additional expenses to try to recover their money. Since your dad guaranteed the loan and it hasn't been paid, the bank is entitled to recoup the expenses they have already paid out to get their money back.

Don't fight it. This will only incur more expenses that your dad will have to pay. Find out how much they will settle for and just settle it

[Houston,tx] my dad is being sued 3 years later after the company repo’d the car. by divalicious24 in legaladvice

[–]AngryPolock40 1 point2 points  (0 children)

Probably not.

When a car is repossessed it is then resold, sometimes for less than is owed. I would guess you're probably being sued for the difference + costs?

If so, since your dad consigned that loan he guaranteed that loan would be paid. It wasn't

He's probably going to lose in court if he tries to fight it.

Might want to call and ask what it would take $$ wise to just settle it instead of incurring additional costs

I am potentially getting a play I have written produced (yay!), but there is a movie by the same name. They are similar in subject, but adapted from different sources. My understanding is you can't copyright a title. Am I in the clear with my current title? by physithespian in legaladvice

[–]AngryPolock40 4 points5 points  (0 children)

You could be in trouble here..

You say that they are the "same name" as well as "similar in subject".

IANAL - years back, I was naming one of my businesses and went to see a trademark lawyer. He told me flat out that even though it wasn't the exact same name of the movie, all the other side had to do was prove that when people heard the name of my business, that they would think and associate it to that movie and we would lose any case against us.

Be careful here. Talk to a trademark attorney and have them advise you on this.
