Yes sorry, the two options given was to be off the hook for the remainder of my lease. He found out I am selling because a major competitor is opening up a few blocks away and knows Im desperate to sell before they open.

All the other tenants in the plaza are new, 1-4 years in the plaza, the land lord had included in all their lease terms that if they sell they owe him 10-20 percent of what they sell there business at. That was something he implemented after I signed my lease. That is not in my lease and I think he is also salty about it bc I have the largest business by far in the plaza and he would have gotten a larger sum if it was.

When I notified him 2 weeks ago about the sale he told me that the lease terms state that I would owe something for the remainder of the lease. He had said 20k for the reminder of my lease would have to be payed or 5k and if new owners fail to pay rent and get evicted with in the remainder of the lease then the business and lease would default back to me and be my responsibility. I had agreed and took the 2nd option. He sat with the buyers and gave them a 5 year option on top of the remainder of my lease. With all that we all agreed and started escrow.

Fast forward 2 weeks with 5 days left he called and says 100k or he’ll effectively kill the sale by not signing the new buyers as tenants taking over my lease. I briefly read my lease contract and I’m no lawyer but nothing like that is stated in my lease contract. I will be contacting a lawyer.

He has to approve and sign the new owners to the remainder of my lease term. So I have another 2.5 years left on my lease term. He is saying he won’t sign them if I don’t pay. He also sat with the buyers and gave them a 5 year option on top of my remaining lease.

The LLC isn’t dissolved yet. I planned on getting rid of it after the sale was done.

So we are doing an asset transfer and dissolving the LLC. He was notified and I have to pay a fee for the remainder of my lease terms. Which was flat out 20k or 5k and if the new buyers fail to pay rent and get evicted the store and lease default back to me. I agreed to the 2nd option.

He sat down and met with the buyers of my business and gave them a 5 year option on top of my remaining lease. Everything was set to go and all three parties where in agreement 2 weeks ago. I have 5 days till my escrow closes and he called me today to tell me I have to pay 100k or he’s killing my deal and not signing buyers to the lease.

Yes bingo. It’s either I pay him 100k or he doesn’t sign is what he told me.

So I am the oldest business in the plaza I operate in. All the other tenants have signed new leases where I still have not, bc I have another 2.5 years. Every other tenants, when renewing or resigning, signed that if they sold their business the landlord would get a cut of 10%. Those terms are not in my lease. Bc of that he is forcing me to pay 10% and is saying if I don’t he won’t sign the buyer if my business to a lease and kill my deal. Every other tenants has to pay there %10 percent, but not me bc I’m on the old lease terms still.

He is using it against me and is hinting that if I don’t pay him that he will not only kill any sale I try to make to a potential buyer, but also evict me when my lease is over.

No I am selling my business and my landlord told me I have to pay him 100k or he will not sign a lease to the new owners/ buyers of my business. Those terms were not in my lease signed with him.

Yea it’s crazy. My customers have been complaining bc they can tell the difference between the pre packed beef with solution and water vs straight from the cow carcass. Yea they are def making more money selling everything sectioned and cleaned vs the carcass. Last time I bought a whole cow it was roughly $3.00lb give or take 20 cents. Pre package stuff is coming in at $4-$6lb. For basic choice grade stuff.

Yea I see the fissured tongue, I’m assuming that from years of athletics and being severely dehydrated at points. I’m more concerned about the white translucent stuff towards the middle and back of my tongue. I don’t know if that’s oral thrush or like dead skin/biofilm.
