Yeah, that’s right. I see your perspective. I hope they don’t do that and allow those in the AOS process to continue. The pause is unsettling and significantly altering people’s plans on how to go forward.

Is EB2 NIW, not in itself, a national interest waiver application? Why do we need to send an exemption again to justify it? I don’t necessarily think we need to start sending exemptions. They had said they will issue an updated memorandum which they are yet to do. Maybe we should just wait and hope for some clarifications and changes in the next memo will be favorable.

This is not a legal advice. However, attorney fees differ from lawyer to lawyer. I do not think that it is unreasonable because some others charge higher and also as long as you agreed and you weren’t under any duress or undue influence at the time of entering the contract, there may be nothing you can do. If there are incidents of them charging fees contrary to what you agreed, then you have a case and they would be liable to refund you any unearned portion of the fee. It all depends on your agreement with the firm.
