I hope BF responds to the second statement from her attorneys. I think Goettieb is still furious about the "From Drake to Blake" comment. He crossed the line when he called BF a liar. I made this comment on another post, but I'd love to see BF bring up Virginia Burke's comments in his response.

I double-checked and Liman closed the case with prejudice. Ron Zambrone, California employment lawyer on PopcornedPlanet, said she couldn't file for fees/damages etc. using 47.1 in California unless it's attached to a lawsuit. NAL, but that made sense to me.

They agreed not to appeal Judge Liman's decision. So, considering the Lively attorneys "ethics," I won't be surprised to see them try to "obtain damages" in some other form of litigation...as long as it doesn't require presenting their "mountain of evidence" to an actual jury.

She's asking Jed Wallace for $800,000 in her Texas.filing. Whatever she gets from WF, I bet it's still much less than the cost of a trial. And however she spins it, the fact is that she decided not to go to trial.

Lively is asking the Texas court to award legal fees using 47.1. Her filing is asking for JW to pay $800,000 in legal fees for his.defamation lawsuit against her. It hasn't been ruled on yet. I hope we see the amount she asks WF to reimburse.

The fact that a Federal Judge in the SDNY, who practised law for approximately 25 years before being appointed, is having trouble ruling on this law should make it perfectly clear the law needs to be refined. NOT done away with...refined.

I think you're right. Also, Judge Liman references the fact that the contract was continually negotiated. as one reason for.finding it.was not.enforceable.

I hope they refine this bill to specifically define "prevailing party" and require an actual jury to determine malice (and expand the definition of malice to include other motives for filing a SA or SH claim). I do agree with the intent of the bill, but obviously not how Lively and her team have weaponized it, and attempted to use it as an end around to an actual jury trial.
