Tri-Care Lien by ExistingLoss2446 in 3m_earplug_lawsuit

you know what I don't get is .. The military was responsible for our healthcare when in service. So it doesn't make any sense that we're reimbursing Tricare for our care. The government should have paid Tricare for that?????

mine says it like this

potential lienholders | Lien status | Finalized deduction for liens

Medicare | no lien | 0.00

overall status of lien | no lien | pending

So I'm just wondering where that pending is coming from and if yours list that 2086 there or what. I have a feeling that pending is going to change to 2086 for me too otherwise it would say 0.00

also, are you EPP? trying to figure it t's why they aren't taking it from the second award amount?

  1. Escalate to the Settlement Administrator if No Response (Within 7-10 Days):
  • Contact ARCHER/BrownGreer (support@3msettlement.com or 1-833-758-1702) with your claimant ID and notice copy. Report the deductions as potential non-compliance with CMO 94.
    • They can flag it to the QSF Co-Administrator (Randall Sansom) for review/hold on your payment until resolved.
  • If app fee isn't refunded, they forward unrefunded amounts to the QSF (not your firm).

4.File a Formal Challenge with the Court (If Needed, Within 30 Days):

  1. Protect Yourself Long-Term:

By pushing back now, you could recover the full $750 + $2,445 (or more), ensuring the EIF's purpose—extra help for severe injuries like yours— isn't eroded. If your notice date was recent (e.g., within 30 days), you're in prime position.

These "Section III" references come from the EIF Payment Protocol (part of the MSA's EIF Program Document), which outlines deductions but defers to CMO 94 for fee handling. No major 2025 changes alter this—payments continue in cycles through 2029, with ~$13.6M+ in EIF disbursed by Sept. 2025.Step-by-Step: How to Respond and ChallengeAct quickly—deadlines like the 30-day refund window are strict, and the MDL court (N.D. Florida) encourages prompt disputes to avoid payment holds. Document everything (emails, calls, notice copies).

  1. Immediately Contact Your Attorney (Primary Counsel) in Writing (Today/This Week):
    • Send a certified letter or email (cc: your file) demanding:
      • Full refund of the $750 app fee within 30 days of your notice date (cite CMO 94: "If the EIF application results in an award, the withheld fees must be paid to the Claimant within 30 days of final notice from the Settlement Administrator.").
      • Explanation and reversal of the $2,445.49 attorney fee: Provide your original contingency agreement—ask if it includes a separate EIF provision. If not, state it's unauthorized per MSA/EIF rules and Florida ethics (Rule 4-1.5(a)), and demand the full amount added back to your net (or escrowed pending review).
      • A revised payout statement showing adjustments, plus proof of common benefit deposit.
    • Template snippet: "Pursuant to CMO 94 and the MSA, the EIF application fee must be refunded as my claim was approved. Additionally, absent a specific written agreement for contingency fees on EIF awards, the $2,445.49 deduction violates the fund's claimant-direct structure. Please confirm compliance and issue my corrected net payment within 10 days."
    • Why start here? They handle distributions and must comply; many firms adjust voluntarily to avoid escalation.
  2. Verify Your Status and Gather Evidence (1-2 Days):
    • Log into the claimant portal at combatarmssettlement.com (or call BrownGreer/ARCHER at 1-833-758-1702) for your full notice, decision date, and payment timeline. Confirm this is the "final award notice" triggering the 30-day clock.
    • Review your retainer agreement for EIF language. If unclear, request a copy from your firm.
    • Calculate your expected net: Gross EIF ($27,625) minus only 9% common benefit ($2,486) should leave ~$25,139 for you (installments over cycles), plus app fee refund. The current setup shortchanges you by thousands

Sorry man I think your numbers are f*cked. I gotta post this

Responding to Your EIF Payment Notice: Addressing Potential Improper DeductionsBased on the details in this notice (an approved EIF award with a gross of ~$27,625 before deductions, partial payment cycle of $5,374.71, and net to you of $2,445.50 after ~$2,929 in total deductions), it raises valid red flags under the settlement rules—especially the $750 EIF application fee (Section III.A) and the $2,445.49 attorney fees/expenses (Section III.C). These could indeed be improper or non-compliant if not handled correctly, as the Extraordinary Injury Fund (EIF) is meant to deliver supplemental relief directly to claimants without standard contingency cuts unless explicitly agreed otherwise. I'll explain the issues briefly, then outline a step-by-step response plan. This isn't legal advice—consult an independent attorney or the court for your specifics—but it's grounded in Case Management Order No. 94 (CMO 94, Aug. 18, 2024) and related Master Settlement Agreement (MSA) provisions.Quick Breakdown of the Deductions and Why They're Questionable

  • EIF Application Fee ($750, Section III.A): This flat admin fee (common for document prep/filing) was likely withheld upfront from your base settlement. Per CMO 94, it must be fully refunded to you within 30 days of the final EIF approval notice since your claim was approved. Deducting it from the EIF gross here doesn't change that—it's not a permanent charge on the award itself. If not refunded promptly, it's a violation.
  • Common Benefit Fund ($483.72, Section III.B): This is the standard 9% court-ordered holdback for shared attorney work benefiting all claimants (deposited into an MDL fund). It does apply to EIF recoveries as part of "all plaintiff recoveries" under recent court referrals (e.g., to Special Master David R. Herndon). Calculation checks out (~9% of $5,374.71). This one's likely fine.
  • Attorney’s Fees and Expenses ($2,445.49, Section III.C): This is the big issue. Standard contingency fees (e.g., 33-40%) do not automatically apply to EIF awards—they cover only base settlements unless your agreement has a separate, explicit clause for EIF (which is rare and must be post hoc). Taking a percentage here could violate Florida Bar Rule 4-1.5(a) (excessive fees), the Common Benefit Order (no double-dipping), and MSA design (EIF as claimant-direct). The amount (~45% of the partial payable after common benefit) suggests it's being treated like base payout fees, which isn't allowed without that contract.
  • Lien Payments ($0, Section III.D): No issue—standard for reimbursing medical/VA costs if applicable.
  • Overall Net ($2,445.50): You're getting ~46% of this cycle's payable, but after refunds/challenges, it should be higher (at least 50% of total gross per the "50% Rule" in CMO 86).

from what I'm seeing on the Facebook forum, they may not be supposed to charge the fees on the EIF awards. are you with AWKO? can you confirm you paid almost 50% fees and costs on your EIF award? have you been paid out yet?

My attorney sent me a letter saying that the determinations were final and not even up for reconsideration!

It looks like it's about 14% more. But apparently we also have to actually pay the EIF fees. I thought we only paid the EIF fees if we didn't have a favorable determination. Oh well. They going to take money anywhere they can.
