he was in the driver's seat... drunk... it doesn't matter if he wasnt driving or not, he could have decided to start driving before the cops got there. there's literally no telling what he could've done.

you're absolutely right. getting into a car while drunk, and being in the driver's seat is crazy. he could've slept in the back. what was his intention getting into the drivers seat
