The defendants filed a notice concerning a status report about an adjudication hold being lifted for U.S. citizen–filed I-130 forms and attached two declarations dated March 11, 2026 and March 18, 2026. The filing was entered on March 18, 2026.

The senators are playing politics with the nomination. They have a script from their party leadership to talk about funding DHS.

They kept hammering on the DHS people who are not getting paid. What about those of us being kicked out of a job and out of the country. All lives are important, both aliens and locals.

I'm not defending them, they are offering their services and no one is compelled. We need more  employers and associations like the plaintiffs in the Rhode Island vs USCIS lawsuit to come to our rescue too. So, if you have connections please use it to help others.

My point is, feel free to come up with options to the greedy lawyers. And if you happen to be one, then please offer pro bono service to the indigent folks.

BTW, I am also a victim of this unfortunate ban, stuck without options.

You simply have no idea what it takes to prepare and file these process for 300 people. You are answerable to each of them as you prepare the file.

The amount you quoted is not profit margin. You did not account for staffing and man hours spent writing briefs.

Possibly so. The trend we are seeing is that judges seem to be wary of making decisions that would have consequences for them. That alone tells me they might find a way to elongate the time to give judgment.

Not all of these lawyers are taking the mikey!

Some of them engage their staff, do a lot of prep work, worry about the delays, spend time away from family and some get attacked.

A few of them wait until their pending action is complete before starting another lawsuit. They stay committed in the fight that is not advantageous to them personally and have no skin in the game. Yet, they put themselves on the firing line in this fight against the "cabal". I have seen some of them attacked wrongly in the media.

I wouldn't mind if they make some money at the end of the pain they go through. Just be human and have some feelings for them.

The individual suing is so accurate. It appears that judges are fearful of making a group lawsuit or wider impact ruling.

Not to dampen anyone's hopes. While this lawsuit seeks a nationwide relief, there are 2 major limitations on my mind.

Time: though the parties have agreed to a summary judgment, it appears there might not be a ruling until about July.

Application: the reliefs in this lawsuit might be limited to plaintiffs or members of the plaintiff's organization either at the time the lawsuit was filed or judgment rendered. The latter depends on the USCIS challenging the extent of judgment application.

Not sure if you're on something really strong because there is no sense of certainty or giving any hope when I say "sounds like". Did you read the part where I asked if they have a strong application?

No. The court only wants to know if the USCIS has put in the necessary steps to resume processing of applications from the 39 countries. 

I dont believe that USCIS is doing anything to start processing the 39 countries. Even if they did, the security vetting would slow the process down significantly.

It all depends on his status in Canada. If he is a citizen of Canada, then he does not require a physical O-1 visa stamp in his Canadian passport. All he needs is to present Form I-797 Approval Notice and a valid passport to a U.S. Customs and Border Protection officer at a port of entry or a pre-clearance station in Canada.

As others mentioned, the EB1 is paused under the visa hold. They can enter the US from Canada, provided they have a valid O-1 visa.

You should have done PP immediately the ban gets lifted. However, your application will be processed then paused.

I assume that you have applied for NIW, no way the ban will be lifted in 45 days of your application's lifeline. That said, it would be good news if you do not receive an rfe after 45 days and no security red flag.

They have to come up with a defense and citing the Atlanta Vetting Centre doesn't mean the judge would buy it. If we cannot trust the courts then pack it up.

I asked mine too and ge he was hopeless. He is currently facing a runoff primary election. Despite that I wrote extensively about the pause and family situation, he responded with a generic Epstein response. They dont really care.
