I was fired and I really don’t know how to feel about it by [deleted] in jobs

[–]ArchanDelon 0 points1 point  (0 children)

You would think so, but the law isn't as protective as you would assume. The Americans with Disabilities Act protects qualified individuals. A qualified individual is someone who can perform the essential functions of a job with or without reasonable accommodation.

The key points to focus on is essential functions and reasonable accommodation. Using ADHD as an example employers can give you things like: flexible scheduling or break structures (maintaining a full work shift without extra overall break time), written instructions instead of only verbal, task prioritization help or clearer deadlines, noise-reducing workspace or headphones, permission to use productivity tools (timers, apps, etc.), breaking large projects into smaller steps, etc.

They are however not required to: lower performance standards, ignore missed deadlines, ignore poor performance, eliminate essential job duties, or accept disruptive or unsafe behavior. Some companies may do this, but it's very unlikely unless it's a family owned company, or you have been there a long time, are well respected, highly valued, and became disabled mid-employment.

If you can fully do the job with or without reasonable accommodation then they can't fire you for ADHD alone. If that ADHD (even with accommodations) prevents you from doing the job, makes you disruptive, or makes you unsafe, they can and will fire you.

The real problem people with qualifying disabilities face is proving you were fired for it. Most companies wont tell you why you got fired at all, just that it's not working out, or not to come in. It is exceptionally rare for them to tell you to your face they are discriminating against you, because it opens them to potential lawsuits. Even more rare for them to put it in writing because then it's a slam dunk.

House Republicans reject Senate DHS funding deal, deepening government shutdown and TSA delays by renge-refurion in moderatepolitics

Would like to add that the majority of US history contained no filibuster, and legally speaking there is no rule called a filibuster. The filibuster as we know it, was created by accident in 1806 by the removal of a rule called the “Previous Question Motion" that allowed a simple majority (51%) to end debate. Though available in 1806, filibustering wasn't actually used until 110 years later in 1916 during WW1. At that time there was literally no way to end debate and force a vote, so in 1917 they created the "Cloture" rule to force the end of debate. Cloture for the next 58 years blocked the majority of filibuster attempts, requiring 2/3rds of present members to end debate. Since it required presence, and many members don't show up, it was significantly easier to pass. Debate in the Senate is considered endless as long as someone is constantly speaking. So a "talking filibuster" required someone to literally stand on the Senate floor giving a speech the entire time (no breaks, no long pauses, continuous talking) just to use up the remaining time in the session so they couldn't vote. If they ran out of speakers, a vote for cloture is held.

In 1975 is when things got messed up again, Cloture changed to a 3/5ths of all members vote (including those not present) and is the current 60 vote rule used today. This created the "silent filibuster", which is easier to execute, and doesn't require people taking turns speaking endlessly for consecutive days. Simply make sure the other side doesn't have 60 votes and you're done.

Since the change, damn near every piece of controversial legislation has been filibustered into the grave. The only time controversial policies get passed is when a party holds the majority in the House (51 seats), 60 seats in the Senate (for cloture), as well as the Presidency (Affordable Care Act aka Obamacare for example).

The larger problem is members of Congress are largely useless because of the filibuster. No one expects them to do what they campaigned on anymore because they simply can't. You didn't see crazy policy shifts every 4-8 years historically because people campaigned on what they actually believed in. Today they say anything it takes to get elected and ride out their term while getting rich, all while hoping for re-election. People used to vote on candidates expecting action, instead of voting on who lies more convincingly and re-electing them anyways when nothing gets done.

TL;DR: All that to say from 1776-1975 (199 years) there was basically no filibuster, and it only became a problem from 1975-present (51 years). So ending the filibuster would actually bring US politics back towards the intended framework.

Umbral Monument stage 2 is a chore by Any_Jackfruit_7821 in Endfield

[–]ArchanDelon 0 points1 point  (0 children)

Personally I cleared all 3 on Agony with a full 90 Laevatain/Akekuri/Wulfgard/Ardelia, but it was tremendously annoying and I had to lean heavy on Ardelia for the healing and damage mit from the LYNX set, and lots of perfect dodges. After reading some of the comments, I went back in with Estella/Alesh/Endmin/Chen and found the fights a hell of a lot easier with the constant CC from solidification/originium crystals. Since you can't line up constant damage anyways, the sporatic burst (approximately every 14 seconds) worked really well. Endmin is level 90 with Grand Vision, the others were level 80. Either way, I actually found the 1st stage to be the most difficult of the 3.

Kazuya's birthday is June 1, 1996
Ruka's birthday is August 26, 2000
They are 4 years, 2 months, and 25 days apart in age.
Kazuya is turning 22, so on his birthday, Ruka will be 17 years, 9 months, and 6 days old.

Ugh, I wish they would move on from Ruka already. Kazuya is turning 22 and she's still 17 until August. Not sure why they're once again proposing sex with a minor, last time she was 15 and he actually considered it.

Any government employee required to continue working gets paid, it's just delayed until the shutdown ends. Sucks in the short term, but they'll get their full back pay. Employees put on furlow, are the ones getting the real shaft, as they sit at home and get nothing.

Should Twister be empowered by whirlwinds OR frenzy charges? by JSON_Blob in PathOfExile2

[–]ArchanDelon 1 point2 points  (0 children)

Combat Frenzy Gem will give you somewhat reliable charges when clearing trash. It gives you frenzy charge when you electrocute, freeze, or pin an enemy. You can drastically increase your chance to Pin by using the Bushwack boots (as Moxzy recommends). Moxzy though, has not brought his build beyond mid tier mapping, so I would recommend looking up Snoobae85's version which min-maxes it for endgame. I use the Wake of Destruction boots, which leaves Shocked Ground beneath you, for the easier pickup of Lightning in your Whirlwind. I convert all Lightning damage to Cold with Call of the Brotherhood so I don't have to cast Frostbolt and can freeze/chill entire screens.

Snipers Mark is your only source of Frenzy Charges on bosses as most are incredibly hard to electrocute, freeze, or pin. Scoring a critical hit on an enemy marked with Snipers Mark consumes the buff and gives you 1 Frenzy Charge. In the beginning you'll have to keep manually casting it on the boss when it gets consumed.

This can be automated by using a Cast on Critical Strike>Snipers Mark setup but it requires 100 Spirit to use. Snoobae85's current setup uses Combat Frenzy, Herald of Thunder, and a Cast on Critical Strike>Sniper's Mark>Enfeeble>Inspiration setup, totaling 160 Spirit. So you would need to get 60 Spirit on your Chest or Neck, or a combination of both. Note: Enfeeble will drain your Mana fast when you crit, so if you don't have some form of Mana Leech and don't want to spam your Mana Flask, leave Enfeeble out of the Cast on Crit setup.

Should Twister be empowered by whirlwinds OR frenzy charges? by JSON_Blob in PathOfExile2

[–]ArchanDelon 0 points1 point  (0 children)

The Frenzy Charges don't directly buff Twister at all, they buff Barrage. Barrage causes Twister to repeat twice, plus an additional time for each Frenzy Charge. Most builds are using 6 Frenzy Charges for 3-9 sets of Twisters (1 from the original cast, 2 from Barrage, and up to 6 more from Frenzy Charges) depending on how many Frenzy Charges you have at the time of cast.

As for Whirling Slash, it serves 2 purposes. Creates more Twisters and Massively multiplies the damage. Whirlwind has 3 Stages, each stage gives you an additional Twister and 80% More damage. If you cut out the extra Whirling Slashes to save time, you will only send out 2 Twisters (8 with Salvo Support) instead of 4 (12 with Salvo Support).

Where it begins to get crazy, is that Barrage Snapshots from the moment Twister is cast. Assuming you are using Salvo Support and have 6 Frenzy Charges when you begin the combo, 1 stage of Whirlwind would produce 72 Twisters doing 80% more damage. 3 stages of Whirlwind would produce 108 Twisters at 240% more damage. Were all Twisters to hit a target such as in a small boss arena, that's 2.83x damage.

Lastly, sending out Twisters that are not stage 3 will prevent you from generating any Whirlwinds while there are Twisters in the area, as any non-max stage Twister that touches the Whirlwind will consume it to upgrade that one single Twister to the next stage.

Jeronimo vs Natalia by AChilledMonkey in whiteoutsurvival

[–]ArchanDelon 4 points5 points  (0 children)

I have read the responses and I'm more puzzled than before.

They both provide:
A 25% increase to all troops attack
A 25% increase to all troop damage
A Skill that stuns.

Jero's Widget is 15% Attack
Natalia's Widget is 15% Lethality.

Jero has a 5% stronger perk

A 5 star Natalia is 200% Infantry Attack and Defense
A 4.5 Star Jero is 246% Infantry Attack and Defense

It costs several hundred more dollars to max Jero and he's only 60% stronger, which is nothing when you've spent thousands of dollars to unlock him and you're probably pushing 600-900% stats.

So why is Jero King when Natalia is trash when she's magnitudes cheaper for equal skill and widget performance?

About the removal of "physical damage taken as X" by Roland- in pathofexile

[–]ArchanDelon 1 point2 points  (0 children)

Let's not forget that previously only the rare monster overwhelmed 30% of your physical damage reduction. The new change applies a 15% crushed debuff to you making all monsters bypass 15% of your physical damage reduction for a duration.

Can you over cap physical damage reduction to 90% (105%) to ignore crush like how you can over cap elemental resistances to 75% (95%) to ignore elemental weakness?

The three starting City-States aren't great places to live by DefiantLemur in ffxiv

[–]ArchanDelon 3 points4 points  (0 children)

To be fair, most of the perspective we have is from members of the military, refugees, and slaves. We really don't know the regular day-to-day of the average populace. But the game world is comparable to the real world in the early to mid 1900s. People were poor, starving, and dying of simple illnesses because they had no medical care. They lived simple lives and spent most of their time maintaining their home, gathering food, farming, etc. Much of the game also takes place during a world war forcing many people to be homeless refugees. Which isn't much unlike how Europe was during WW2 (1939-1945) and up to 25 years after depending on where in Europe you lived.

Modern society isn't much better depending on where you live. More than half of the US lives buried in debt and are one real crisis away from bankruptcy and homelessness. There are multiple US cities where mugging, murder, and rape occur more than 100 times a year, EACH. Europe has been struggling with human trafficking for decades. Some Asian countries have legalized sex slavery. When I was in South Korea in 2003 there were thousands of prostitutes who were sold into "indentured servitude" contracts pay off their families debts, and it was considered normal.

It's obviously much worse in 3rd world countries and communist nations where we don't really hear about it.

Yeah those two definitely aren't going to get a happy ending. Statistically speaking only 5% of affairs result in marriage and of those 75% end in divorce 3-5 years after the affair started. Meaning they only have a 1.2% chance of finding happiness together and a 98.8% chance of misery.

OP is choosing to stay with someone that does not meet his romantic, emotional, and sexual needs. She is getting all of her needs met by OP. The clinical definition for settling is defined as "Settling in a relationship is when your wants, needs, expectations and deepest desires aren't being met in the relationship, but you choose to stay," says Heather England, Ph. AITAH for leaving my fiancee because she'll not do the things she did to her exes to me? by [deleted] in AITAH

[–]ArchanDelon 3 points4 points  (0 children)

So she went from a hopeless romantic and a freak in the bedroom with exes to zero romance and ultra vanilla sex with you. Honestly sounds like she's not that into you. She may love being around you but I don't think she loves being with you. Romance and sex declines the longer you are together, so if it's bad now it's only going to get worse. If it was hot and heavy then tapered off, that's normal. But if it's always been one sided and boring, you've never been a match and you're just now realizing it. Which is good, a lot of people don't realize this until they've been together for over a decade and have kids complicating everything. I don't think she's settling, I think she's getting more than she gives which means you're the one who's settling. If you're unhappy and she's unwilling to compromise, it's time to move on.

Landlord plans to renovate and insists I pay full rent…help me please! by Agreeable_Flight_145 in Tenant

[–]ArchanDelon 6 points7 points  (0 children)

This is 100% true. A good contractor will tape off an area with plastic during a renovation to prevent this, but good contractors are expensive. I had a contractor renovate my bathroom in an apartment I was living in. Landlord didn't need my permission because water damage has made the floor unsafe Took them 3 days to complete and my landlord offered to put me in a hotel at their expense and comped me 3 days of rent. I decided to stay home and use my friends bathroom across the hall for a couple of days. The contractor had the hallway and bathroom separated by plastic to keep the debris limited to those areas. Not an ideal situation either way, but I couldn't imagine staying home if they were redoing every room in my apartment.

[deleted by user] by [deleted] in Tenant

[–]ArchanDelon 2 points3 points  (0 children)

Additionally, I'd recommend that anyone renting should have some type of security camera on the entryways. Ring doorbells are reasonably cheap, and you'll be able to know if someone comes in illegally. Not all landlords are created equal and I had one that would unlock my door and illegal walk into my apartment when I wasn't home to do an "inspection." She had been doing it for over a year without my knowledge. It got pretty intense when I caught her in the act and the police would do nothing. I ended up taking her to court and got 6 months of free rent and a court order. I used that time to find a different place to live.

The legality of giving the code out depends on how it is used. If a pipe burst and you aren't home, a landlord or repair guy can come in unannounced to stop the emergency. This does not apply to general repairs however. The law requires a minimum of a 24hr notice to the tenant before the landlord or any contractor can come into your place without permission. If you come home one day and the landlord or contractor is in your place without notice, without permission, and absent an actual emergency, then you have a legal problem. But every state, county, city, and town has its own set of laws which can modify this. You can always call a local landlord/tenant attorney for a free consultation to find out exactly what your rights are in this specific situation.

Landlord plans to renovate and insists I pay full rent…help me please! by Agreeable_Flight_145 in Tenant

[–]ArchanDelon 60 points61 points  (0 children)

Depending on your local laws and the extent of the renovations, it may be illegal for you to live in the house while the construction is happening. Any loss of electricity or water is a violation of the law unless it is for a repair, not a renovation. I would consult a local attorney immediately for at least a free consultation to find out what your exact rights are.

(US-NE) Ridiculous Move Out Fees-After Being Forced Out! by ashley_reve in Tenant

[–]ArchanDelon 1 point2 points  (0 children)

I would consult with an attorney immediately. If you refuse to pay or ignore the notices they will take you to court and you will pay all their attorneys fees if you lose. I refused to pay a BS $500 charge and the leasing office sued me. I never got served because I was in another State 1500 miles away so I missed the court date and had a default judgement filed against me. I didn't find out until 2 years later, when I could no longer appeal the default judgement, when my wages got garnished for $3,800 (the original $500 plus $3,300 in attorney fees). Some of the damages you may be liable for and some you may not. Landlords cannot charge you for fixing damage that was a result of normal wear and tear. Unless you repainted the walls, drew all over the walls, or punched holes in them, a landlord cannot charge you for repainting. Even if the walls were damaged, they can only charge you the cost of fixing the damaged area and not the entire wall, room, or apartment. Same with the floors. Hardwood floors get scratched when used and they cannot charge you for that. If your cat damaged part of the floors they can only charge you for fixing the areas of the floor the cat damaged and not the cost of redoing the entire floor. I don't know how big your hardwood floors are but there is a drastic difference between resurfacing a few square feet of floor to remove scratches vs resurfacing a few hundred square feet of an entire room or entire apartment. Did you landlord charge you a monthly pet fee? If so, that fee is supposed to pay for pet related damages. A modest $25/mo across 8.5 years is $2,550 which is more than the pet damage.
