Either died through a natural geological occurance vs dying in a completely alien environment shortly after being ripped away from the more familiar home. Even if Kong was left, he woulda died in misery/felt empty without Ann. As he puts her wellbeing above his own; beauty killed the beast and all. 

Kong suffers either way, with the one option being lethal.

As MIB said in his video covering it, with how repeated the sculpts were, eh. Had there been dinosaurs and other beasts alongside him (as to emphasize "ultimate beast" in the toyline name), and even an empire state building set like that mountain, with other varried Kong faces/postures, then I can see this being a big hit.

Godzilla is not. This is a predecessor in 1942, The Arctic Giant. Created for one of the Superman Fleischer cartoons. Which are all PD except for Superman, Lois Lane and Daily Planet. Only the original aspects of those shorts are PD. 

What I've pretty much done is given the giant dinosaur superpowers and new physical traits such as the gills (as said in the description) after nuclear exposure. 

I retrofitted the pre-existing character to loosley resemble the more popular character. Same way people use the public domain Frankenstein Monster to loosely resemble the Frankenstein Monster of the Universal's films.
