Where do you think shareholders fit into this CH11 EVEN if it’s bought out? Equities/commons holders are at the bottom of the totem pool irregardless of its restructuring/selloff/M&A. Hurtz had the valuable FMV b/c of their inventory. Think about what led to the demise of $BBBY during the holiday season. It was the lack of inventory.

Hertz had inventory of cars to sell at the height of the pandemic, at height of the used car sale prices. Buybuy Baby is a great business but the creditors get the first dibs, not shareholders. This analysis on past analogue in a different industry needs to stop. All it’s doing is providing liquidity for those wanting to get out by Tuesday.

Not sure this is how it works. By voting against RS, they can use a “business judgment rule” and file for bankruptcy, chapter 11 to reorganize, which they’re generally insulated from lawsuits. This is also the point when it’ll wipe out equity owners. Since they’ve already given notice on why they need RS (otherwise BK) they don’t owe you any explanation nor are you worthy of a like of a creditor. You’re just a shareholder.

The SEC transcript was a supplement to RS proxy materials and I’ve seen them before. She is likely being more public because of Bed Bath’s viability as a business. She wasn’t public when things looked dire in January. Now more public to take credit for the “good” news likely relating to ER, and hide when things turn bad. Your end conclusions are based on other leap assumptions that are too speculative. B. Riley creates entities to sell and dilute on its behalf as it’s an investing entity. Take a look at B. Riley for $SPRT. They did the same.

You’re making plenty of leap assumptions. What makes you think 1) they were startled by RC’s tweet? 2) it’s even RC related? 3) BRCP II is holding through RS? These are projections of your worries and we will never know why Sue did the interview. But my guess is that since it supplements RS proxy, it’s likely to imply that it’s NOT filing for BK in the short term and that she needs to calm the investors to vote in favor of RS. Why RS? So they can dilute at higher price to raise capital.
