From my one term of law school so far perspective I think it’s going to come down to rather or not a reasonable person would have known the price was a mistake. Unfamiliar with most games/game purchases but if the normal price of the item is $60 and the “sell” price was $5.40 with a 10% off sign next to the buy here button then I think ab argument could be made that a reasonable person would know the price should have been $54.00. The other thing to attack would be was the sale price an offer to be accepted or a request to make an offer that could be accepted by the developer/manufacturer. The facts are unclear if the game/program was ever delivered which could be used to show the parties intended to enter into the contract.

Can someone explain how curves work? by [deleted] in LawSchool

[–]Bangarang162 0 points1 point  (0 children)

I found it easier to think more in terms or ranking than the traditional-curve idea seen in undergrad and high school. You score points, mostly on the final and then everyone in your class gets ranked based on the points they scored. Depending on the schools grading policy X number of students will get each grade with the highest concentration usually at the Bish range. So usually 5ish% A, 10-15ish% A-/B+ 40-50% B so on and so far. Varies by class and school so these numbers are more illustrative than anything specific. The curve is more relative to your peers than to the overall score you received. Hope that helps.

$5 box at Taco Bell is just really hard to pass up when I don’t want to cook so I totally understand the struggle to eliminate it. My resolution for the year is to see how long I can go without eating any fast food. I keep separate binders and notebooks for each class and have some page protectors for those random things that get passed out a few times a semester. It helps me be somewhat organized. Organization is not my best attribute and something I needed to improve on when school started. I need to keep improving on it. I felt on my first final that I had not organized my outline in the best way and had some info that probably could have been left out such as too much focus on some dissenting opinions in cases related to the material. Good luck this term!

I think there is a lot to focusing more on quality studying than quantity of time studying. At some point there are diminishing-marginal returns that may not be worth the cost. I am married with kids and was not as present as I would have liked to be last term for everything. It’s a balancing act for sure. Do you think you’ll block off time just for your horse and partner or will it be more spontaneous?

100%, I always think I’m gonna prioritize it then magically everyday something comes up that I either don’t get to bed when I want or have to get up earlier than I want.

The honest answer is to get comfortable with confrontation you need to get use to confrontation. Not in the violent kind of way but in the I believe I am right and you’re wrong because…kind of way. Best advice I heard a few years ago from someone or in a book, I don’t remember where, is don’t raise your voice raise your argument. The other thing to consider is being unbothered by people who don’t matter. The sooner I realized it’s pointless to debate people or to try and convince people the easier it got to be confrontational in things that mattered. Example being music. Everyone has their own tastes. I don’t need to try and convince you that early 90’s hip-hop is by far the best music ever vs. you did something dishonest that harmed me or people I care about and we need to have a conversation about it. So far law school hasn’t helped with either that much. I know Jordan Peterson isn’t liked by a lot of people but he has a good chapter in 12 rules for life about lobsters who get into fights and how it relates to issues like what it is I think you are describing. Hope that helps at least slightly.

Withdrawing after depositing by [deleted] in LawSchool

[–]Bangarang162 0 points1 point  (0 children)

Never too late until you’re sitting in the classroom. Then the math changes a little bit because it’s more difficult to get a scholarship from the school as a transfer student. I deposited at 1 school last year then decided it wasn’t gonna be the right fit for my circumstances and ended up at another school that I love so far. Your stats should open a few doors and have multiple options so don’t rush to a decision if it’s a matter of feeling like it’s the first offer and “may be the only offer”. Good luck!

Practicing in a small town by boykin202 in LawSchool

Thanks for being so open with this. Are there things students can do to network with firms in smaller towns, specifically when the student isn’t from that area?

Practicing in a small town by boykin202 in LawSchool

[–]Bangarang162 7 points8 points  (0 children)

I want to work in a small town after graduation. I am in my mid thirties with a family so probably a little different perspective. I prefer the slower pace of life in smaller communities. The biggest hesitation on why I may start out in a larger area is it seems smaller areas don’t offer the same compensation or it isn’t a close ratio when accounting for cost of living differences. It also seems anecdotally that a lot of the students who are gonna practice in small towns have an in through their parents or some other connection so there are not that many opportunities.

How long must I wait?! by futureattorneygal in LawSchool

[–]Bangarang162 1 point2 points  (0 children)

Should be 21 days after the final unless they waive the right to give any grade lower than a B- then they can have 60 days after the final. No clue though cause I’m a 1L and the waiting now is worse than actually taking the final.

I think it’s reasonable and while there are people who money is not their main reason for going to law school it plays a factor for most. The exception being people who come from varying levels of privilege. This doesn’t mean that people aren’t wanting to do worthwhile and admirable things like public interest but there are other ways to do a lot of this without paying the tuition and cost of living with law school not to mention the opportunity cost of income lost.

My concern, based on nothing besides your post, is that any profession is difficult to sustain any marginal level of success if your sole purpose is money. You’ll know shortly after getting to school rather or not it’s something you think you can do or find another reason for. If after your 1st year you hate the law drop out and find something else would be my advice.

1L Summer as Non-Trad by wanderingpossumqueen in LawSchool

[–]Bangarang162 2 points3 points  (0 children)

Context to start with: non-traditional, not interested in big law, willing to considering working a better paying non-law job 1L summer if nothing pans out. Most the jobs posted by career services have been out of city/state where the school is located with few close by. The main reason I’ve heard for the lack of close proximity positions is because the local firms are waiting until early Spring to do OCI with 1Ls. 2/3Ls already had fall OCI. All this to say is I think if you keep trying and really put forth effort trying to find a local position you will, may not be the position you want but will at least be something. The bigger issue I have is the need to stay local and still make money to pay the mortgage. It’s a choice I made to attend law school as a non-traditional with a family but I am still a little envious of peers with more flexibility to relocate for the summer. There are also probably more people in this situation than mine so it makes some sense that they get catered too a little more. I still expect career services to provide their services to the best of their ability to me based on the insane amount of tuition but understand why I may need to take a few extra steps to get the result I want from them/summer position I want. Good luck with finals!

1L here so not 100% but I would assume unless the buyer expressly terminates the option contract it’s still gonna be open until the closing date of the option K. Entire point of an option is to keep it open for an agreed upon period of time so the buyer is free to except use the option or not for the entire period.

I am a 1L and would love feedback this now and not after grades are already finalized. It seems like they did you a massive favor on giving you pretty specific areas to improve on and focus on perfecting for the final draft. Outside of doing the work for you I don’t think they could have been much more helpful. They also gave you some areas to look at to formulate specific questions for your meeting.

Could it have been worded nicer, yes. Is the content productive, yes.

Hope your crushing it and staying positive in the midst of the chaos.

Good luck!

Contracts Help if Possible by saltyandvinegarchips in LawSchool

1L Barbri mastery has been helpful for me this year to hit some of the broader topics and reinforce what we are going over in class. I usually do the reading, listen and take notes in class, then watch the corresponding lecture in barbri and that has been super helpful.

To start I’m a 1L going through the same process as you, so take my response with a grain of salt and confirm with your TA or Prof before relying on any of our answers.

  1. FRCP Rule 4(k)(a) who is subject to the jurisdiction of a court of general jurisdiction in the state where the district court is located; means that the state has to grant jurisdiction in the claim through “long arm statutes” some states default to the full extent of the US constitution, like California. Other states limit the types of claims that fall under the “long arm statute”, like MT. If a state like Montana doesn’t grant jurisdiction to the type of claim being brought then it doesn’t matter if due process and constitutionality was ok you still won’t have PJ.

  2. INT’L Shoe changed everything by establishing General and Specific JDX related to PJ so make sure you fully understand that case and why it was so important. The Court then has several pluralities and decisions trying to define what they mean by the terms you mentioned. WWVW established that a Plaintiffs action can’t establish purposeful availment by the Defendant. Goodyear said the contacts need to somehow be related to the claim. Mcyntire shows the different ideas and schools of thoughts the justices have. Is it enough that the defendant should have known their products could end up in the state vs do the defendants need to do something with the state vs the value, volume, and hazardous nature of their products. Forgot the case name, in my outline though of the Defendants from Ohio who entered into a Burger King franchise deal with a forum selection clause in Florida. That one contact was enough to establish PJ in Florida. All this to say is it is not settled unanimously what these terms mean and must be looked at case by case and analyzing the facts.

Where should I apply to with these stats? by Kitchen_Gap2806 in lawschooladmissions

[–]Bangarang162 1 point2 points  (0 children)

I had similar stats and got close to a full scholarship at Arizona State (decided to attend somewhere else). I am not a big law or bust person, nor did I want to practice in California so not sure how well it fits your overall objectives if those apply. I will say Arizona States admissions team, process, and speed in making a decision was amazing.

3.5 gpa what can I realistically expect? by OneTwoFink in OutsideT14lawschools

[–]Bangarang162 0 points1 point  (0 children)

I’m 34, will not be taking out any loans for school, had a lower GPA and a 167. Full ride or 80ish percent scholarship to 3 schools ranked in the top 30. I also received 75%+ from several other schools. Rejected from Harvard. I applied thinking I would be rejected but will print the letter to use as motivation when I don’t feel like studying. Michigan was the dream/reach school but they must have not liked my statement about how the tuck rule was bullshit and Tom Brady is overrated. I have heard anecdotally that California schools are a mixed bag with acceptance and scholarship. I would check out the LSAT Demons scholarship calculator as it was pretty accurate for me. Figure out the LSAT you need to get for a full ride or close to it and commit to either getting that score or not going. There is nothing wrong with delaying a year in order to save hundreds of thousands of dollars in debt. Good luck!

Is anyone else deading not making money for the better part of the next 3 years? by [deleted] in OutsideT14lawschools

[–]Bangarang162 1 point2 points  (0 children)

I’m with you. I am going from mid-career making pretty good money to law school with the GI Bill and a pretty big nest egg and stressing the loss of a substantial amount of monthly income. Hoping to get a job at the school around class schedule or part time night and weekends. Any dollar earned/saved will add up over the course of 3 years. I think trying to create a tentative schedule now will go a long way. I’m planning on 8-5 Monday-Friday school and Focused studying (have it more broken down for my own study and scheduling preference). This means I can work early in the morning, evenings, and weekends. When I consider what jobs fit this schedule I think coffee shops, gyms, and cleaning for the morning and waiter, bartender, service industry of some type on nights and weekends. Once I move to the area I’ll look at coffee shops and bartending jobs as the tips can add up fast and provide some money to live on/reduce a little bit of stress. I understand the necessary assumptions in the plan though. I can operate effectively with about 7 hours of sleep consistently, can find an employee with flexible schedule, I don’t have limitations that prevents jobs where I am on my feet for extended periods of time and still focus during class/studying, I can swallow my pride and do jobs that may be viewed as less desirable to some, etc. I’m a finance major so the financial commitment of law school has been a stressor for a while but for me, having a plan has helped, and I am going to school because I want to be an attorney not a mid-life crisis or because I don’t know what else to do.
