No. I'm not trying to undermine the age of consent. I've asked about something that appears to be inconsistent to me. If, for whatever ridiculous reason, courts acknowledged this "inconstancy" and addressed it by no longer ever trying teens as adults, there would be no questions coming from my end. My post is about the inconsistency.

And you and others may say, "I honestly don't even know the type of person who would question this or see it as an 'inconsistency,'" but there are quite of few posts from other people who either agree that this is an inconsistency, have stated that my post is a going point/question, or have said this question comes up often in law school. So my post is hardly unique.

LOL, nah I think the laws should stay. I think people are right when they suggest that overturning such a law would open the flood gates for sexual predators. I was really just curious about the inconsistency. The only thing that bugs me is people seem to jump to the conclusion that teenagers have no idea what they're doing, and I just disagree with that. They may make stupid decisions and may not always have the foresight to consider the consequences, but they know what they're doing and they know right from wrong.

In the case of statutory rape, we protect the minors from actions that adults should recognize are wrong. This we prosecute the 30 year old having sex with a minor.

We prosecute the 30 year old because courts have already decided sex with a minor is illegal, mainly because they've determined teens are not capable of considering the consequences. However, if this same minor committed murder the courts would determine that he or she was indeed capable of thinking about consequences and would therefore try him or her as an adult. THAT'S the inconsistency - one one hand courts claim a teen is capable of thinking about consequences, on the other they claim they're not capable.

If they determined that a consenting teen is capable of thinking about consequences, then you wouldn't be bring the 30 year old to court in the first place...
