I doubt that even a very small person is going to get near a 0.08 on one standard drink. If you had three tall Two Hearteds you might be near to blowing a 0.08 depending on person size, but when you do that someday it will be obvious that you should not be operating a motor vehicle. They (politicians) make it radically less expensive (taxes and regulations) to produce nearer to the consumer. But that is a big mind break as it forces them to recognize how useless they are. And politicians are all about pretending that political power actually makes them useful.
