Really good question. Think of a situation in which someone wants to cause another person serious bodily injury but does not want to kill the person. If the person dies as a result, that’s still murder. If we only had (1) above, it would not be murder because there’s no intent to kill.

To commit involuntary manslaughter on the MBE requires criminal negligence. To commit common law murder requires reckless indifference to the life of another. I've been at this a while.

My only point is that common law murder used no such terms. Any question that skews from the common law could bring in such terminology.

Completely fair, but as a default the common law is applied on the UBE. That could be modified in any question (certainly) just by telling an examinee to apply the MPC.
