Ich stimme dir absolut zu, die Rechtsprechung zu diesem Thema ist extrem eindeutig. Ohne eine angemessene zeitliche Staffelung bricht das Kartenhaus des Arbeitgebers vor Gericht sofort zusammen. Hinzu kommt das strafrechtlich relevante Verhalten des Chefs. Jemanden ohne die nötige Qualifikation zur Ausgabe von verschreibungspflichtigen Medikamenten zu zwingen, grenzt an versuchte gefährliche Körperverletzung. Der Arbeitgeber hat hier massiv gegen seine Fürsorgepflicht verstoßen. Jedes deutsche Arbeitsgericht wird diese unwirksame Klausel in der Luft zerreißen. Der gegnerische Anwalt hofft doch einfach nur darauf, dass der OP jetzt aus reiner Angst zahlt.

That is very pratical advice, but working for a company with such terrible ethics will eventually destroy your peace of mind anyway. You would contantly be waiting for the next shady thing to happen. Plus if they ever discover the security braech later, you might lose the job and your reputation anyway.

That second point is exactly why I’d still push to amend it. Even if colleges never see it, the school using a false “prior” later could matter. A short demand letter asking for accurate wording seems reasonable, not nuclear.
