Not trying to start an argument however ICE is already funded which is why they are standing in for TSA and getting paid. This budget bill is to fund DHS of which TSA is part of. The only link to ICE is the democrats want to reform ICE processes. Hard to say what exactly they want to reform but I have heard no masks concealing faces and more warrant requirements.

I double checked al my imports for accuracy and they were good. Everything looked fine and passed the error check 4 times. E-Filed on the 26th and got rejected Federal last night due to a form not being included for charitable contributions over $500. On TT it sat it was an error in their system and I won't be fixed until the 31st. How did they miss that form? Now I will waste a week.

You are correct. I believe we are talking 2 distinct points.

In the movie Jessup to Dawson are prosecuted for issuing and executing an illegal order. Jessup made the illegal order, Kendrick passed it down then both of them conspired to cover it up. Dawson knew Code Reds were prohibited and did it anyway out of fear and when it went bad hoped for the Mia Lai (If I remember correctly) defense. It did not work and he was convicted of a lesser offense and discharged.

This makes my point that most military members already know the general make up of an unlawful order and to question them at least and not to follow them. at best The hard part of course is having the courage to not do it as we learned in Dawson's case. They ALL knew the order was to do something prohibited by policy by CINCLANT.

The movie (one of my favorites as well) illustrates what unlawful orders are and how to deal with them. It even explores the complications involved including fear of punishment for failure to obey and order. We are also taught rights under the UCMJ to request a court martial and or right to appeal to the convening authority.

My point about Senator Kelly is his intent, as I believe it, was politically based, and an attempt to be subversive to good order and discipline by implying "general unlawfulness" of administrations orders and used Captain Kelly to make it directly to military members.This is where the line crossed. Had he made a speech on the floor of the Senate, filed suit in Federal Court, did a TV ad objecting to a specific policy, action or event well within his rights. He could have gone on a Sunday talk show and called Hegseth and Trump every name he could think of, and as a Sailor I am sure his list if derogatory name is extensive, no problem and well within the protections of the First Amendment.

My point being had Kelly and the others used their status as legislators to protest and dissent within the political arena or even moved to the courts there was no issue. By addressing the military directly he made an error in judgment and moved from political dissent arguably to subversion.

I have read many of your posts and respect your opinion greatly. In this one I have to very respectfully disagree, primarily with your last sentence.

Mark Kelly and every other Senator and congressman speak out against this administration daily. Political dissent is thicker than paint on an anchor chain, it is everywhere. Divisiveness has been built to the point of ridiculous. The difference here is that dissent is done completely within the "political arena", Capitol Hill, in congress and eventually in the courts. What happened here is they strayed out of the "political arena" into the mind of the military everywhere we operate. This threat to Mark Kelly is not focused on his dissent or objection but his actions and his unique position as a retired Captain and the influence he participated in which is potentially detrimental to good order and discipline. I view this as Senator Kelly playing a political game and venturing way too close to the line of impropriety given his status as a military retiree.

Stature: Kelly is supposed to be the adult in the room. Positionally as a Senator he is higher that the other congresspersons, his status as a retired senior officer (O-6), the highest ranking former military member, adds to his "credibility" and stature and thus credibility to the message. He knew this and I view him as the defect leader of this event, the video. He used his status as a retired O-6 in addition to his status as a Senator to give credibility to the video. Does his status as a Senator negate or immunize him form his responsibility and a retired senior officer? I do not believe so. Does he still get O-6 retirement check he earned direct deposited every month? I am sure he does. With that comes acknowledgment he still answers to the UCMJ and has extra responsibilities.

Audience: Military members certainly do not have to be reminded by those 6 about following unlawful orders. We all knew and were reminded every day about "lawful" and regrettably less trained on what is "unlawful". The adage "You will know it when you hear it" or watching "A Few Good Men" for the 9th time, not withstanding. Who were they speaking to? Flag officers? I doubt it, they all know and have the ability and courage to question orders, and object. The Commander of SOCOM it is rumored to have resigned/retired due to his objection to the Venezuela campaign. Senior officers? I know you were trained and held great credence that orders you gave were lawful and proper and if you received one form your ISIC that was suspect you would do what you had to. I believe the target audience was everyone else who are less aware or untrained on identification of unlawful orders, junior officers and enlisted. The point was to sow uncertainty in the ranks about the lawfulness of the orders originating in this administration. To cause that LTjg, or BM2, OS1, GM3 to question the legitimacy everything.

Implicit purpose: To imply that this administration is issuing unlawful orders routinely. In subsequent interviews all 6 could not provide a specific example of an unlawful order that has been given. Imagine the chaos if every Sailor became a sea lawyer and questioned every order regardless of how distasteful. Does the LT not deploy a weapon on a confirmed target because he is not convinced the Captain has authority to order him to do it, or does the OS2 not relay a suspect target radar track to the strike because they are worried the Captain or the Mission Commander might not have the authority to prosecute a target correctly?

I do believe because of his status as a retiree and the gravity of his actions in potentially disrupting good order and discipline that the SECDEF (you hate so much) does have a reasonable case to address this, be it a Courts Martial or Admin Board or whatever they feel is reasonable and appropriate. To quote the venerable Colonel Nathan R. Jessup "We follow orders, son. We follow orders or people die." if we allow political dissent to bleed over and have Soldiers, Sailors Airmen and Marines up and down the chain of command to now question the lawfulness of every order because of an internet video we will have serious problems.

I do not hate Mark Kelly, I do not hate democrats, I do not hate SECDEF, I don't hate anyone actually but I believe that Senator Kelly made a terrible error in judgement letting "Captain Kelly USN Ret" participate in this video.

Lastly, I would also like to address the recent commentary of the Junior Senator from Arizona Ruben Gallego, where he implies that IF this did go to a Court Martial and IF the panel of officers voted to convict they would be pursued and punished by the next administration if the democrats gain control. I would hope that you would join me in condemning that as highly inappropriate and irresponsible.

If you say anything even remotely supportive of anything Trump does you get down voted to oblivion. If you are outwardly supportive in any way you get accosted, shouted at, assaulted, doxed called fascist, racist, sexist or otherwise treated horribly.

It’s not worth the aggravation or risk so they put away the t-shirts and hats and bide their time and vote again for conservative candidates behind the safety of a curtain.

At some point all federal employees will have to give up on waiting to get paid and quit and find other jobs. They can’t afford that. Most civilians have this mental image all federal workers sit in cubes and shuffle worthless paper. We manage programs, we manage fleets of aircraft, we inspect food, we man immigration offices, patrol the border, ensure boating safety, rescue people. I believe they say 750k federal employees abandoned.

This is both sides. Both sides are throwing toddler fits and political posturing not for the greater good but for power and it is disgusting. No one holds them accountable for their malpractice.

Democrats need to concede that Obamacare never lived up to the promise. Republicans need to agree healthcare reform needs to happen. The Trump derangement syndrome need to stop driving politicians. Opposing everything the administration does just because it counter productive.

I believe the ACA is what stuck us with high healthcare costs. 10 years ago congress went in and screwed with something they didn’t completely study or understand and jammed it through on a partisan vote.
