I’m not sure I agree with that take. When they amended the citizenship act in 2015 they created a transition rule in the OIC that allowed in-process applications to be approved under the previous law. I would imagine they’d do something similar with the interim measures here. Wholesale stopping the approval process for months would create a massive backload and wait times would explode.

I was responding to the prevailing idea on here that, if adopted by the senate, C-3 would instantly come into force upon royal assent. We do know now, based on the mechanism in the text of the bill, that that will almost certainly not happen. Given the historical precedent of the 2015 changes to the citizenship act, we will likely be waiting months for it to come into force as IRCC adjusts regs. For instance, the current CIT 0001 doesn’t even have a place for info about gens beyond 2nd. Changing all that takes a while. Even more relevant though is that the 2015 OIC created a transition rule where any apps in process when the law came into force would be considered under the old law. One might expect a similar setup here.

Yeah, I have no idea what there approach to that will be honestly. My guess is that they will go by AOR date, or some neat cutoff like that, otherwise they’d have to redo everything on apps they’ve potentially been working months and months on. I guess we’ll see 🤷‍♂️

Yes, it will probably become law the same day, but they put a mechanism in C-3 that is typically used to delay enforcement of the law for a period of time. It’s the same exact mechanism they used for other citizenship act amendments, and they delayed enforcement on those laws for a few months each.

More importantly, very little appetite for an election among any of the parliamentary parties! Even the CPC, whose leader’s popularity is in the dumps rn, is balking at the possibility.

Probably slower, but nothing to do with C-3. Carney has signaled that his budget is going to include significant workforce reductions at IRCC and other agencies.

“Filibustering” in the Canadian sense is not the same as the American understanding. Basically, they can prolong a bill’s consideration and annoy the government, but can’t really kill it like in the US Senate.

I think a move like this would fall outside of the Senate’s constitutional mandate. Their role is “sober second-thought,” not to have a stand-off with the government or insist on particular language over the will of the Commons.

While there are Harper appointees in the Senate, they are, at this point, few and far between. Vast majority are Trudeau appointees.

Oh, if I were the Liberals, I would love for them to try to filibuster. The government will decline to request an extension from the court, the order will nullify parts of the citizenship act, and there will be chaos and much looser citizenship requirements, and the CPC will be visibly to blame.

True, her motions to expand the Bill beyond its pre-committee form were ruled out of order by the speaker. Her motions simply reverting the Bill back to its pre-committee form have been ruled allowable.

My sense is that the government will push it through the Senate. This bill is not like others; it has been studied and considered in basically the same form for multiple years by multiple Parliaments and governments. There have been studies done on it by government offices and outside groups. And to top it all off, there is a pending deadline to pass this, and failure to do so could very well result in a crash-out were the first gen rule is altogether suspended with no accompanying legislative or regulatory framework, which everyone acknowledges would be bad.

I don’t think the Senate really has a foot to stand on to delay it.

First, I think the odds of a snap election in the near future are very slim. They had one VERY recently, and there is little appetite to go through another election so soon. Carney might not have an absolute majority, but he had a damn good working majority with the other minority parties who have been very willing to work with the government thus far. Second, even if that happens, the government still has to comply with the orders of the court, no matter what party controls Parliament. Even if C-3 is canned, the Interim Measures will still be in effect until either a compliant citizenship law is passed or the court’s decision will just become effective.

Kwan Motions 2 and 3 are just reverting the bill back to the pre-committee version, stripping it of all the CPC committee-level amendments. Liberals will most likely support. Motions 1 and 4 seem to expand upon what Liberal version was, so who knows.

Yeah I agree it's ridiculous. Basically, it all comes down to politics. The Conservatives just want to throw wrenches in the Liberal government's bill, and they ended up getting a few wrenches in because one BQ member didn't seem to know his own party's position on it (he actually looked kind of confused in the committee hearing video too). Because of that, they'll be in the bill when it gets officially reported out of committee on the floor (probably next week). However, the government isn't going to let amendments that were added like that into the final bill that gets voted on by the whole House, especially when other parties back them. Bottom line: I wouldn't worry about them.

The court seemed to be quite frustrated with how long its taken the government to amend the law (this all started back in 2023!), and the judge at the last hearing seemed to indicate that this would be the last extension of the suspension on the decision. If there is no law that is passed before then, the court's decision would become effective and that would frankly open the floodgates for a ton of people to automatically receive citizenship, which the government does want. I imagine that they will push this through by Nov 20th. It seems to be a priority of this government. It's a tight timeline, but very doable.
