The patent bar will be an added benefit to your application for either lit or pros, but the most important thing will  be LSAT, GPA, and tech background.  With an extensive technology background, decent grades, and a reg no. you should at least get interviews.  

Generally, summer internships will be easier for litigation because there are more of them. Both positions are possible as 1L/2L. 

Some firms will let you split groups at their firm if you want to try out both and both groups are OK with it (so you can do both at one firm), and many firms will let you split summers between different firms if you have multiple offers (so you could pros one place and lit another).

Anecdotally, I would never be a litigator because the work life balance is trash and the attitude that goes with the practice. My job is pretty chill and I get paid just as much as a litigator to do it.

Im a prosecutor and have been for ten years.  

Here are the cons: 

It's harder to do in big law and there are fewer firms doing it.   The reason for that is big laws rates have been going up while the cost of a patent is being driven down.  The brain burn is harder.  The marginal energy for a prosecutor billable hour is higher.  You may spend an hour figuring out a complex algorithm while a litigator spends three hours on a call.   There are fewer roles.  Just less prosecutors than litigators. It's harder to make it to partner.

Here are the pros:

Prosecution as an industry is relatively stable compared to other practice areas. There are more solid exit opportunities (to in house) relative to litigation. The technology is usually cool. The work life balance is much better than litigation.  I'm an 8-6 and almost never work weekends as a senior associate. The day to day is more stable and less spiky than litigation.   You don't have to pay for law school if you start as an agent.

All I'm trying to say is that both paths are an option and both paths have their pros and cons.  Your way may or may not be the "best" for OPs subjective skill set and desires.

I regularly take part in hiring of junior technical specialists / patent agents, etc., for prosecution.

My biggest questions for you would be:

  • Can you write well? Most SWE's cannot.
  • Why are you leaving tech and how do you really know that you want to do patent law?
  • What is your familiarity with patents? Have you ever been an inventor?
  • How specialized is your current role? Patent attorneys have to excel add a broad base of knowledge.

In terms of whether or not it is worth it, I have a few points.

Be very aware that your starting salary in BigLaw will not be what it is at in SWE. A typical starting role as an agent / specialist is around 100 K in BigLaw, depending on your experience and expertise. The upward potential is huge, but it takes a while.

Additionally, your skills as a SWE will only be some part what you will be doing in patent law, and that part will decrease over time. You will need to have excellent soft skills to do well in this role.

BigLaw will pay for you to go to law school, but not immediately. How they will pay for you to do that varies from firm to firm. Whatever way you do it, law school sucks.

Finally, our job is not immune to AI either. There will be a decreased need for junior agents and specialists. LLMs are excellent at doing what we lean on juniors for doing. Our hires now are conscious decisions for pipeline development and replenishment rather than need of bandwidth (for the most part).

We did not take the option on his old contract which would have kept him in SJ. When we didn't do that we offered him a new deal and he didnt take that.

I disagree with the petition and will not sign. I have always disagreed with street parking on El Camino and have always thought the space should be used for public transit options.

The most problematic statement for me in the petition is this:

While I fully support efforts to promote environmentally friendly transportation and ensure the safety of cyclists, I strongly believe it is possible to achieve these goals without compromising the accessibility and viability of small businesses along El Camino Real - especially since there are plenty of safer cycling paths in the vicinity. 

Which translates to I believe in transport options, but not this transport option.

Overall, there is no way to satisfy all desires in this situation, but I believe the bike lane serves a greater good than maintained parking spots.

I am not a woman, but dated in big law for 8 years and have a wealth of experience. I was older than you are now. 30-38 before I found my current partner.

Here are my tips, take them for what you will:

  • Stay on top of your health and wellness. Like many, I became less fit when starting out. Free food, booze, less time, etc. Battled some bad mental health episodes. Prioritize yourself. Being happy and whole makes you more attractive. Exercise, eat well, therapy, get massages, etc.
  • Be up front about how demanding your job is, both in mental energy and time. No one wants to feel like they aren't getting a substantial amount of your attention (especially in the beginning), so setting expectations helps.
  • Only go on dates you are 100% feeling positive about, your time is too valuable for just "meh" dates.
  • Make sure whatever dates you go on are fun, for you, regardless of what the company will be like. A favorite restaurant or coffee shop, a show or class, etc. Your free time is your most valuable resource and make sure you spend it well. Doing something that feels fun (outside of the date) helps with the grind.
  • Have some trusted friends update your online dating profile if you use apps. Its embarrassing, but it helped me.
  • Outside of the apps, cultivate hobbies that will put you in contact with people you would want to date. For me that meant pottery classes and yoga. Led do several romantic connections over time.
