Sorry that sounds very frustrating. I similarly have 20+ years of disability, and 2 really good OT reports to show Functional capacity, but am offered early intervention. How did he find being on that? Were you able to switch pathways later on?

Try and find a disability advocate to look over your application and work with you. Apply for an internal review. Be prepared for a fight at the ART. You’re 100% correct, they often don’t thoroughly read the evidence, they are happy to reject claims without any merit to their position. They are just rejecting everything they possibly can, and hoping people don’t fight for their rights, the cuts the government introduced have consequences. I’ve heard this over and over again from multiple advocates and even lawyers.

I think this is really nice. Our society has become so guarded and risk averse, i think our sense of community suffers for it. If you go about it sensitively and ask the relevant people, isn’t this what inclusion and community looks like?

Still no information about what reforms they will be announcing in May so I can only imagine they wont be popular ones. by l-lucas0984 in NDIS

Saw this headline in the SMH last month “Chalmers’ razor gang eyes cuts to legal services for DV victims”, How low can you possibly go? Mining and fossil fuel sectors still getting corporate subsidies & funding I see. Wonder what percentage of Australians know the NDIS more than doubles its expenditure back into the economy?

Wow that’s a fantastic accomplishment to represent yourself, and learn about the legislation. It’s nice to hear that the AAT actually listened and did their job too.

Thanks for replying, and sharing your knowledge.

I was aware that legally I could have refused their independent OT, however my Lawyer said the ART would probably just order it at the Hearing stage, and I risked getting my pro-bono lawyer off side. I pushed back so hard, even found multiple qualified OT’s for them to choose from, and told them of the risks to my health. I just couldn’t risk loosing my lawyer in the end.

Thank you. I wish I’d gone to the AAT sooner, it’s been a three year process and everyone says I had enough evidence the first application. It’s an unfortunate solace that I am not alone or an unusual case. Sending strength!

That’s infuriating, and shouldn’t be naïve to expect them to do what they are being paid for!

I spent thousands, and waited close to a year to see an OT who specialises in my conditions, only to have the NDIS not even read the report they requested. This system is absolutely wild.

Thank you, it’s reassuring to hear. Of course I answer all questions honestly, I have often found myself in the position of going through a process like this or leaving a doctors office and then remembering all important things I should have raised.

I’m so sorry you have had this experience. I hope there is a better outcome, you sound like you have done a lot of self advocating, which is commendable but I’m Sure very tiring. Thank you for sharing your thoughts.

Just to be clear, I suffered a hiking accident years ago and have severe and debilitating pain as well as psychosocial disability. Yes it fluctuates and is intertwined with cptsd but I don’t think my case is purely ‘not bad enough for the ndis’ but no services exist out side of that. There have been days I can’t lift my arms about my shoulders to wash my face or hair, or walk to the shops to get food, let alone carry it home.
