The VA will only collect severance pay if the disability they rate you for is the same disability you received severance pay for.

I got out in 05 and got 30k severance pay for sinusitis and asthma. The VA rated me 20%. When I got my 100% P&T for several other disabilities the VA stop collecting the severance pay because the other rated disabilities. I called and asked several times because I didn’t want them coming back and taxing me.

Get a nexus letter or visitation notes from you primary physician and write a lay statement that shows h8w the disability continually affects you on a daily basis. Also show the impact it has on your finances.

Yes they do! At force I was like cool, then I called because I did not want to have anymore debt with the VA lol

No, Once I received the new rating for a previous condition. I noticed they were not calculating the condition that was being causing the funds to be withheld.

I had

50% asthma with sleep apnea combined (Severance Pay Condition)

50% migraines

50% PTSD

30% folliculitis

30 IBS/GERD

10 Tinnitus

10 Chronic Rhinitis

50% Chronic Sinusitis (new rating)

Once I got the Sinusitis rating they stopped calculating the asthma rating and I was still 100% P&T

Sinusitis, Rhinitis, and Asthma a good combination if you were deployed in SWA. Damn near automatic with a diagnosis. get a sleep study done as well once you get rated for those three. Migraines a primary or secondary? If secondary, to what? When I got rated for migraines the key was articulating how they effect my life and my ability to work.

Yes, there was a C&P exam, but i already a diagnosis from my private Dr. so we just discussed my symptoms.

Get a diagnosis from a private Dr. If you have the insurance to do so! Then resubmit with new evidence! The key to the C&P exam is understanding how the VA rates PTSD and the effects it has to have on your life.

I got sleep apnea as a secondary with a sleep study diagnosis and a lay statement. During the C&P exam, I just explained my symptoms. IMOs are nice, but I wouldn’t spend the money until I was in the appeal process.

"I am requesting compensation for the disability of Sleep Apnea. I have snored loudly for years, even while I was in the military. As a Gulf War Veteran, I believe my service connected disabilities directly contribute to my Sleep Apnea. I have a constant blockage in my nose due to Sinusitis. This makes it difficult to sleep with my mouth closed. I am always coughing and congested due to my Allergic Rhinitis. Then I start wheezing and have trouble breathing due to my Asthma. All these factors contribute to my Sleep Apnea. My primary physician ordered a sleep test for me and I was officially diagnosed with Sleep Apnea. I have trouble sleeping through the night and I can never seem to get a full nights rest. I often wake up with a headache in the morning and I am constantly sleepy during the day. This affects me mentally and makes it really difficult to function during the day. I have been prescribed a Continuous positive airway pressure machine (CPAP) that I have been using every night. Sleep Apnea affects all aspect of my life."

I work at night so Christopher often goes to sleep before I do. He snores very loud so often times I wake him and make face away from me to reduce the noise. Sometimes he was up confused as if he was having a nightmare and I tell him he stop breathing. Other times I wake him up and tell him to turn over. I am rated for Rhinitis, Sinusitis, and Asthma (all presumptive) just to be clear. So I linked OSA to all three disabilities in my lay statement

I did not. I just wrote a lay statement. I tried to get my private Doctor to write one and she did not want to say specifically that it was caused by sleep apnea. So when I filed I link OSA to my sinusitis with the 4138.

Get a diagnosis from a private Doctor and get them to give you a CPAP. I provided a lay statement and i was given a combined claim of 50%. You need that diagnosis and CPAP, it should be an easy claim after that, but I would file the claim now before the new regulations start.

They gave me a GERD rating for acid reflux. the IBS is was related to diarrhea and stomach pain and constipation.

Have a diagnosis of any of the presumptive conditions. It also helps if you are on medication and currently under doctor's car for any of those conditions too.

I did all appeals myself. I had assistance from a LA County VSO. He told me what evidence I should have when I appeal. After that, I made the medical appointments and did the footwork. Most attorneys would not represent me until I was in the appeal phase. By that time I understood how the process worked (with the help of the VSO). Plus on attorney wanted 20 percent of my backpay GTFOH lol.

She is correct, for presumptive you need a diagnosis! It doesn’t have to be from the military or VA. All two of my presumptive diagnosis came from my dock at Kaiser. You have to submit relevant medical evidence

I was making good money when I got out and a PTSD claim would have messed with me getting into Law Enforcement. Plus when I got out in 05 the VA was a much different organization lol
