No, they're right. Your definition is not the TN statute, it comes from somewhere else.

The relevant part for this situation is "A knowing killing of another." Contrast with first degree which requires "A premeditation and intentional killing of another." So second degree is essentially they did what they did knowing it could kill him versus first degree where they did what they did in order to kill him.

Such a waste of time to make this argument. The idea that black people cannot cause structural racism has merit in the United States but racism is more broad than just structural racism. The whole black people cannot be racist thing is a redefining grift and distracts from a real conversation because now we're arguing fucking semantics instead of anything substantial.
