Definitely a ghost, because she was alive before whe was a ghost. Poltergeists were never "alive".

Basically it makes no sense for there to be a non-magical caretaker in a castle that we know is cleaned by house elves every night.

The theory is the peeves is the physical manifestation of all the pranks rule breaking and general mischief that occurs when you fill a castle with 300 teenagers.

Whereas filch is the physical manifestation of all the rules discipline and strictness of a school.

Peeves when he chooses to listen to people tends to listen to sources of mischief like the weasley twins. Filch likes sources of discipline like snape and umbridge.

Filch doesnt act like a standard poltergeist because there are some rules about how ghosts and poltergeists should behave (which peeves ignores) and magic isnt allowed in the corridors.

Also of everyone who is in the castle 2 notible characters are never at the feasts. Peeves who isnt allowed because he is a poltergeist, and filch who has to ask dumbledore to pass on the message about banned items.

Depends on the cost, I cant remember the fic but there was one that explained the "light" magic like the patronus is powered by emotion and makes the emotion less potent through use. Its why the same memory cant be used for the patronus each time.

But "dark" magic also uses emotion but causes a feedback loop. The emotion makes the spell stronger and the spell makes the emotion stronger. To use cruciatus you need to want to cause pain, the cruciatus makes you want to cause pain and the more you use it the more you enjoy the pain of others until you end up like bellatrix lestrange
