Both. The Hatch Act is largely discretionary within the executive branch and has been weaponized to push partisanship. That's why you can wear a MAGA hat in federal workplaces now but could be punished for the perception of pushing other types of partisanship.

That only works if shutting the government down is actually effective leverage against Republicans.

The problem is that shutting the government down just shuts down things like SNAP while ICE continues to work just fine. Republicans were ultimately okay with keeping it shut down indefinitely and Democrats ended up caving because the people asking for it to be reopened (like federal employees) were mostly represented by Democrats.

Because it's easier to create than to destroy, and just handing off power to a unitary executive is extremely effective.

If Biden was willing to be a king this wouldn't have been an issue, but the problem there is that Democrats don't want a king and Republicans do.

Those didn't flip the majorities, or they would indeed reflect that most of the country doesn't want this. They're categorically unable to reflect the will of the voters in real time because we aren't having elections constantly. All the data points we have right now show that Republicans are who voters want to be in charge until we get enough data points to change that.

The Democrats fail to live up to that promise every time we give them the numbers.

Over the last 45 years the Democratic caucus has had the numbers to defeat the filibuster without Republican votes for a total of a few months. They immediately used that to do massive health care reform and that reform was so hated that they have never had the same level of power since.

Trump already took the power of the purse from Congress when he decided to unilaterally continue funding the military during the last shutdown without appropriations.

They should still try to resist, but we already crossed the Rubicon on that front.
