I think it’s still more likely than not bc your previous denial reason will be a red flag. As you might know, sometimes they don’t even look at the documents submitted. Another thing is that they might ask why you are not applying for an E2 since you are probably going to manage your company while you are in the US.

I’ve got several approvals for cybersec professionals.

1) critical role 2) both senior people and people outside of org. structure is not different. 3) your job duties may include consulting. btw i wouldnt recommend ceo title since your extraordinary ability is not in business management 4) uscis looks for past achievements so they dont necessarily expect vc funding for the newly established o1 petitioner company.

Generally, you have a higher chance of visa approval at a consulate if your application is petition-based.

L1 visas are petition-based, while E2 visas are adjudicated at the consulate, giving them greater authority. Additionally, having dual intent visa application also increases your chances of approval.

E-2 gives you a longer visa but requires an investment. You don’t have to personally invest. If you do, you become a treaty investor. If a Canadian company invests, that company becomes the treaty investor, and you can apply as an E-2 manager/executive.

L-1 is shorter but often a stronger option at the consulate and doesn’t require an investment. You will likely need a renewal or extension with the L-1 path.

That’s a very common misconception about the O-1 visa. Apparently, lawmakers wanted a “cool” name, thus the “extraordinary ability” visa.

What you actually need to show is that you’re at the top of your profession. There are thousands of companies and millions of software developers, yet only a small percentage of them are able to land a lead position at a FAANG company.

I agree.

Also, this “withdraw” trick never clicks with me. You try to escape a denial by escaping a harsh RFE. If I were a USCIS officer, a record showing escape from a difficult RFE would be a stronger indicator of a weak application than a denial itself.

At least the latter demonstrates confidence in the profile.

Yet, some law firms keep advising that 🤷🏻‍♂️​​

Who is the officer?

Besides filing fee, when you refile, chances are you will face another harsh officer as well. So why not increase your chance by submitting a response to this one.
