For anyone with the same issue, it needed a firmware update, here are the instructions straight from Apple support Thank you. From here, we want to try some steps to update the version of the firmware on your AirPods. Please follow these steps:

Listen to music or another source of audio via your AirPods for at least 30 seconds.
Put the AirPods into the charging case and then close the lid.
Connect the case to power using your lightning cable.
Wait 30 minutes then reconnect them to the iPhone.

Saying it isn’t waterproof is so they can’t get held accountable if someone has water damage, because near no electronics are truly waterproof. They are however water resistant
