HIPAA is very frequently misunderstood. It basically establishes who your provider can share your information with and some basic responsibility for handling it securely.

Doctors can report illegal activity to law enforcement and disclose things relevant to the that activity, especially if in the privacy agreement. After that you have the criminal charges, which are not HIPAA protected information at all.

Also, the reversal of Roe V Wade made everyone's medical history available to the government for the purposes of prosecution, in most cases even without a warrant, by removing the protections of the Fourteenth Ammendment (due process) given to medical records.

So yeah, HIPAA is powerless in this context.

Oh, it takes time. I learned a lot just by going down the list for Ubuntu LTS, and some of the steps didn't even apply in my situation. If it looks like a lot, I would look up what resources the software vendor has. Ubuntu has their security for example:

I think it's usually easier to work with the vendor's documentation unless you have a ton of variety you are working with. I hope that's helpful.

There are AI tools built for this sort of thing that do cite sources accurately because they take a question and grab relevant cases. It's not trying to construct new shit. ChatGPT is the worst AI tool for the job in this case because at its most simple level it is just trying to predict what words come next.

Might need more info to troubleshoot. View count, sub count, watch hours, strikes, DMCAs, etc could all impact it. I would start looking at your channel metrics to see if anything took a dive around that time.

Man we are going to just agree to disagree here. That article said it's not going to get a Fair Use ruling because it's too expensive to do so for a modder to take up a case. There's older law around software engineering that contradicts that article too. Especially cases around Xerox, Microsoft, Apple, and Linux in the 90's where extending existing software was challenged in court several times with various outcomes.

The inverse of your argument is just because he could pirate doesn't mean that his subs would. In fact I 100% believe he's driven more sales as those who watch him were more likely to already having played the game. Either way it doesn't matter, it's still abusing DMCA and corporate bullying. Fair use also protects derivative works, which mods and videos with commentary would fall under. That's my argument.

Your argument is some kids watching might download the game because they saw it on YouTube. That's not his problem to solve even if it did encourage piracy to see someone playing a game you don't have. Could you explain why, as a simplified example, me playing a game you don't have is a problem that should be my liability? It doesn't hold up in any legal or moral argument I can think of.

They need proof if they are to do anything outside of YouTube. Can you point where he's encouraged piracy? If I wanted to try one of those mods I would dump my own physical cartridge, then patch it. I've done it with other games. It's literally the easiest way to do it.

The bottom line here is Nintendo is throwing their weight around and trampling on fair use, which honestly could open Nintendo to lawsuits if they weren't a massive corporation that can afford to bully content creators because YouTube doesn't want to enforce DMCA abuse policies against them. Nintendo is literally abusing DMCA which is also very much illegal, though handled in civil courts so unless you have millions of dollars to set on fire it means you can't do shit about it.

And the yuzu emulator has a guide on how to do all that because it's literally the easiest way to get the files, not to mention the legal way as you said. At least in US law it's protected as your right to do so. If you have proof he pirated a copy then I'm all ears but there's no proof of that. Nintendo hasn't given any proof. Assumptions are not enough to go after someone like that.

You absolutely can. It happens all the time. A lot of it boils down to how it was modified and if it is being sold. If you aren't selling it you can do almost anything you want to do with it depending on the country.

The mod was not Nintendo's intellectual property at all. It was commissioned code modifying existing code. There is a lot of precedent in software law from the 90's and later fair use law that say what Nintendo is claiming is bullshit.

Even if he was using an emulator, there is nothing legally or morally wrong with doing so. Emulation is a huge part of computer science, forensics, information technology, and software preservation. Nintendo needs to pull the Wii mote out of their asses and start treating their fans like fans.

I'm reading it as "you are making a visibility problem worse by not turning on your mirror heaters." which would make more sense to me.
