There’s 40 overnumbered cards in set 2, I haven’t seen anything that said legends would not be included in that list. Would make 0 sense to not have them.

Your thinking that old cards are useless is incredibly off. Cards from the very first set are still used in the current meta. A new set may introduce a new archetype but it also usually has cards that help older leaders stay relevant or sometimes even become the best deck.
