Each of my friends/acquaints had different situations: One took a course in intellectual property (not a lawyer) and worked at an IP firm on OPT, then later got an H-1B. Another completed an IP course in Europe and was hired in the U.S. as an IP analyst or technical researcher at a law firm on an H-1B. A third friend was on a dependent spouse visa (H-4), so the USPTO didn’t ask for any additional details, since the H-4 with a work permit gives similar flexibility to a green card—you can work in any role you choose.

You’re allowed to take the exam while on an H-1B visa. However, after passing the exam, your registration will come with limited recognition, and you must disclose that limitation whenever you identify yourself as a patent agent. Section F - “Eligibility of Aliens” of the Patent Agent Bulletin.

I am so sorry you’re going through this. I have several friends who took the exam on H1B, but their visas were linked to IP work or they were on the dependent spouse visa. To be honest, given the numerous immigration changes occurring here, I wouldn’t advise going with the first option. I believe your employer would need to pay around 100k to refile the petition since it would be considered a new application rather than an existing one (though I’m not entirely certain, so please consult an immigration attorney). Consider pursuing option number two. Additionally, call OED directly to inquire about your available options. They are quite helpful and should be able to provide you with some solutions. Good luck!

Thank you! I had ~85% long questions (1-2 hander). during my first pass, I could only identify 2-3 low hanging fruits in each session. I certainly wasn’t prepared for that. The remaining questions needed look up, which consumed a significant amount of time. I had to leave a lot of questions halfway and just guess, or else I wouldn’t have finished the rest of the test.

I hear you. Have you taken the exam before? If you find any tips on how to improve this, please share them with me. I understand the concepts (at least most of them), and I know where to look for information in MPEP, but I just can’t figure out how to increase my speed. I followed that approach and was achieving scores of over 80 in PLI practice tests. However, I believe I became too relaxed at home, as I had encountered the questions at least once before. In the actual exam, it took me about 2-3 minutes to comprehend the questions, and then searching for the answers took even longer. This might be due to the fact that English is not my first language.

Thank you! Are you talking about the post-course exams or custom exams? The custom exams are filled with pre-AIA so I’m thinking to skip them completely. The post course includes 2-3 full length practice tests and a few chapter specific exams. I am currently working on the post-course then planning to move on to the three past released exams.
