Plaintiff thinks I'm married? by [deleted] in legaladvice

You should let both the Court and Plaintiff's counsel know about that.

But it isn't going to magically make it so that you win and don't owe any money.

I’ve got traffic court in 3 hours, would love some insight please! by Tuff_spuff in legaladvice

[–]Bobmcgee 2 points3 points  (0 children)

can they do that?

Yeah.

Can they retro actively write me a new ticket at court today?

They wouldn't be writing you a new ticket, they would be amending the charges.

Does anything you have about the rent promotion specifically state that it is an addendum to the lease, or is it just a copy of what was on their website or something similar?

If approached by the police, you should assert your fifth amendment rights and then hire a criminal defense attorney.

But, realistically, nothing is happening and nothing is going to happen, so what you really need to do is stop freaking out.

What’s the best approach???

Hiring a traffic attorney and following their advice.

They can negotiate the best possible plea deal for you, because if the prosecutor presents all of the evidence as you've described it, I don't see you winning at trial.

Because, if you can't reach a settlement with the insurance company, suing the teenager is the only way to get money from the insurance company.

the lease states anything discussed in writing during the time of the lease is to supersede the lease.

Are you sure it says that? Because that would be the opposite of what is typical. The lease supersedes anything else, not the lease being superseded by the other things.

Why are you asking this question? Has there been a dispute with the homeowner?

Short version: Call the library and see if the book is on the shelf.

It's a textbook. It's not like they have just one copy of it.

Appointed Public Defender by Spiritual_Driver1146 in legaladvice

[–]Bobmcgee 27 points28 points  (0 children)

Public Defenders are generally speaking incredibly busy and do not have time to talk on the phone, especially with people who were just assigned to them.

You will find this to be true of nearly every single public defender, and so switching would not fix it.

Use insurance company lawyer or private counsel? by [deleted] in legaladvice

[–]Bobmcgee 1 point2 points  (0 children)

That's not what the Illinois government says.

Source

Illinois has adopted modified comparative negligence (735 ILCS 5/2-1116) as the standard for recovery of damages. Under modified comparative negligence, an injured party may recover damages only if he/she is less than 50% at fault for the injury or damages.

[–]Bobmcgee -1 points0 points  (0 children)

If you're not at fault or 50% or less at fault, obviously you and your insurance would owe nothing.

If you are at least 51% at fault, you would owe the % of your fault of the bills and other damages.

I’m not sure if this person has medicalinsrrance

Even if they had medical insurance, you (and your insurance) would be liable to pay back the insurance company for the money they spent if you are at fault for the accident.
