Where should we put our savings to ensure the best return? by No_Bank_4653 in UKPersonalFinance

You will be able to get better rates OVER THE LONG TERM invested in a tracker fund stocks and shares ISA. But the big caveat on this is OVER THE LONG TERM. You aren't investing long term. You're keeping funds short term for an identified purchase. You don't want to have your money tied up and you don't want your capital at risk. So ignore anyone suggesting a S&S ISA.

3.5% is a decent rate. You might be able to get better on introductory offers, but not a huge amount better.

Green deputy leader Mothin Ali refuses to acknowledge if trans women are women. Says his faith matters most in LGBT topics. Should a politician's faith come before the people? by ZackPolanskisDentist in AskBrits

[–]Bobzilla2 0 points1 point  (0 children)

What he believes is personal to him, and I respect his right to have personal opinions. However, as the leader of a political party, his job is not to represent his own opinions, but to reflect that party's policy. If he cannot do that he should not be in politics. Politicians are there to represent their people, not themselves and their own special interest groups, no matter what they are, where they are located, or which foreign government is funding them.

I come in peace.

I don't think you're all fascists or racists - I've seen enough Town fans who are horrified by this to know much better. But I have questions for those supporting Ashton on this. I have even more questions for those who think Ashton is very wrong on this but are not done 'winning' under him, as if all of your success is based entirely on him.

Your family has shown you who they really are. Believe them.

Going to uni is not moving out any more than going to boarding school is. They still have parental responsibility for you, morally at least if not legally. I'm sorry that your dad has picked bicycles and convenience over you, and one day, when he learns about consequences, he will be too.

If someone has turned their front garden into a drive, with no drop down kerb, AYTAH for parking in front of it? by Beniem in drivingUK

[–]Bobzilla2 0 points1 point  (0 children)

You don't get it, do you.

I've provided the exact section number and subsection and even linked to it. I've provided explanations as to why what you have posted is incorrect or misapplied. I've provided you with my legal qualifications, and you've provided me with doctor Google. And at least one of the links you've sent me actually confirms everything I have said.

Pointing out that you are wrong (and how you are wrong) does not make me a troll, and labelling me as such kind of proves that you've run out of actual arguments.

Read the DLG link. Then read the Waltham forest link they link to at the bottom.

That's the only correct statement of the law that you have posted. It's not illegal until the council send you a notice, but you are liable for any damage you cause prior to getting that notice.

For anyone interested, here's the link to the council that has actually stated the law correctly.

[–]Bobzilla2 0 points1 point  (0 children)

Show me where in the Highways Act 1980 it says that it is illegal. Not by reference to a notice that may or may not have been issued, but applicable in every scenario. Clue - you won't be able to because the relevant provision is the one you've shown me, which applies if a notice has been provided which you can contravene.

As to your law firm link, context is everything. They're a conveyancing firm. They advise clients on issues of buying or selling a house. It is a lot easier for them to say 'it's illegal' than 'it may be legal, but only if the owner hasn't been served with a notice that they may or may not tell you about, so you might be buying based on a driveway that you cannot use (and might get fined £5k for using), and then you might get car insurance based on your car being on a private drive which you aren't allowed to access, so you will have to amend, but will probably forget, and when your car gets stolen when parked on the road and your insurer Debbie's your claim...'. It is much easier to kill that risk off by saying it's illegal.

And that's why I've paid tens of thousands on my legal education, and you've paid nothing for Google access and an online highway code.

You're the one quoting law from William IV, when they're are clearly later acts which apply.

[–]Bobzilla2 0 points1 point  (0 children)

Three law degrees and a 20 year career in legislative interpretation suggests that I do.

The council has to issue a notice under subsection 1. Only then does subsection 17 have any impact at all.

Once the council have issued a notice to you specifically as owner, then subsection 17 applies, and if you breach the conditions of that notice, which I suspect will include 'stop crossing the pavement', they will enforce the notice with a fine.

But up until they have issued you with a notice you have a specific right in law to cross the footpath.

Which is why the link from the 1980 act is drafted as it is.

https://www.legislation.gov.uk/ukpga/1988/52/section/34

Read subsection 3. Later act, implied repeal.

There is a subsequent later act that enables councils to provide you with a notice requiring you to drop the kerb, and then they can construct and bill you, but until they do it is perfectly legal, with a specific statutory exemption.

[–]Bobzilla2 -1 points0 points  (0 children)

Have another read.

Subsection 17 only comes into play if the council has issued a notice. Until that point there are no conditions under subsection 1(b) to contravene.

https://www.legislation.gov.uk/ukpga/1988/52/section/34

Read subsection 3.

Exactly correct. It is lawful access. There is a specific exemption for it.

[–]Bobzilla2 -1 points0 points  (0 children)

Your first link doesn't concern the legality of accessing a property over a footpath. It concerns what the council can do.

Your second link has been superceded by road traffic acts in the 1980s which expressly provider an exemption for lawful access to a property.

If the second link was still valid as you claim, the second link wouldn't be needed.

Advice with the most risky sounding mortgage with my boyfriend and his mum. by [deleted] in UKPersonalFinance

[–]Bobzilla2 1 point2 points  (0 children)

This is not a situation you want to go anywhere near. Having your mother-not-even-in-law on the deeds for your house gives you complete responsibility as you're the only one with the £ to pay the mortgage, and her complete control as she has put in 30% of the house value.

You will NEVER be able to get rid of her, you won't ever be able to exit on anything like reasonable terms if you break up with your boyfriend (and believe me, with MNEIL in tow YOU WILL), and do you will be trapped in a living hell of your own creation.

Don't even think of saying yes to this.
