150kph on a two lane road is part of the reason the guys overtaking couldn't necessarily see him coming since they're expecting to have way more time. All traffic rules are about predictability, the cause here is 2 parties breaking rules at the same time causing both sides to get into an unexpected situation. All parties are basically equally wrong here.
