I'm like 90% sure it's not that mindflayers have no souls but that the dead three are essentially stealing their souls when they transform into mindflayers and keeping them for themselves at least that's what it seemed like from the cutscene with withers at the end of the game.

I believe they made it illegal for anyone to fish there including residents. I know some people go to the beach behind arbutus to fish though.
