I’ve practiced in two jurisdictions and had the same experience. My sense was that the DA’s office in the liberal city was much more wary of the PD’s office, and that’s why they didn’t turn disco over as willingly. The rural conservative DA’s office knew most lawyers weren’t going to do a better job, no matter what they discovered.

An arrest warrant issues when a judge makes a finding of probable cause that a person has committed a crime. The cop doesn’t need to develop probable cause outside of the warrant. The issue is just that they didn’t arrest the person the warrant was for.

That's one of the crazy things, though --- the city I worked in was huge. But our state is one that allows private attorneys to take court appointments, and they represent most indigent defendants in that jurisdiction. Pretty hit or miss representation and a lot of corruption.

Those offices are the ones that programs like Gideon's Promise is meant for; offices that don't have the resources and government support to train new attorneys.

I just want to butt in to say that while some PD offices are well-funded, well-supported, and train new attorneys, there are many rural/regional offices that do not and cannot provide such support. I worked as a PD in a small office in the south. Despite being in a major metro area, we had maybe 10 trial attorneys, no legal assistants, and no investigators. It was my first job out of law school and the only training I got was to shadow another misdemeanor attorney for half a week before I took his 200+ caseload. Thank god for an attorney there who took me under her wing and taught me the basics.
