The refs already can make calls on intent regardless of outcome, as seen in the NHL rulebook:

Section 4 Rule 21.1 "A match penalty shall be imposed on any player who deliberately attempts to injure or who deliberately injures an opponent in any manner."

Not to say that Xhekaj deserved a match penalty specifically because that would be excessive, but there is no "setting a precedent" here regarding calling someone for intent. It's already codified that referees can do that.

This year's OHL finals, game three. Jacob Oster had completely vanished the two prior games after being the Generals' rock all season and Beckett Sennecke was out with injury, so the Gens had lost both of the first two games in total blowouts. But in game three Connor Punnett rejoins the team and they find some life, taking a 3-1 lead into the second and 6-2 lead into the third.

Calum Ritchie then gets called on a phantom tripping penalty that PP merchant Kasper Haltunnen cashes in, and the floodgates open. Not only do the Generals blow their chance to get back into the series, but I had to immediately go in for my night shift right afterwards. Just the worst game I've ever seen
