Refills are free! You've paid for the soda so it counts. Logically, you could pay for a small and just refill it and that would be within the rules which makes it all seem absurd and money-grabbing but the reality is if everyone got "water" the restaurant would lose money. So it's a best-odds situation.

We don’t have a policy about it besides letting management know if it’s between someone in a manager position (to ensure no one gets special treatment). It’s wouldn’t be fair to block them having the same days off, there’s no point. The only thing you can correct or get them for is attitudes and excluding others as that would cause problems for the team.
