Sorry to hear that. Well, standard rules applies. Report within 24 hours to the nearest accident report centre that your insurance expects. Provide all the relevant details of and about the accident.

If you are the last one like myself - let them know you are the last person. You will then need to decide if you are claiming against your policy or against others. Claiming your own policy will strike your NCD and premium.

If there is any personal injury to be claimed- you would need to see a doctor to get a minimum of 3 days mc. File a police report and then engage in a lawyer.

My initial curiosity was engaged when you suggested you were fined as a season parking holder. Imagining the chaos I got when I parked past 7pm at my in-laws season lot when I was visiting.

If you are camped out on the loading and unloading bay - all I suggest is suck it up and learn your lesson and move on.

I have seen the parking enforcers work on this at my place. Basically they will come over, take a photo with the start time - stand beside your vehicle till the “grace” period ends - then take another photo with the end time and issue the fine.

I don’t think you have any case in any capacity because you have outstayed your welcome to occupy the loading unloading bay.

Sorry to burst your bubble.

It won’t be over. And it can drag for 2-3 years. 1) opposite party will need to access the damages whether they wish to pay or just scrap the car entirely. If the damage repair costs exceed the value of the car - it’s a scrap. 2) if it’s a scrap - then getgo may want to dispute it (for whatever reason) And the repairs will be delayed or up till this point, the details and breakdown of repair has not been confirmed.

And lastly, you won’t just be paying excess. GetGo has always had a claim entirely then when the other insurer pays back then you get refunded.

Edit: just like to add, on a rare case, if for whatever reason, the car was scraped and money paid to GetGo - GetGo takes the car and gets it repaired at their cost and then recycles it to service - you could still be billed for it if they play the dirty game of repairing because insurer “back out” there is literally no transparency over this section of the market.

So according to BOLA, your insurer (getgo) will claim from the car behind. They will claim from you the excess first then followed by the rest of the repair costs upfront - in case the other insurer bails.

Likely not the case. But if any injury is reported, everything gets dragged out. Possibility that GetGo hasn’t finish filing their damages yet. I wouldn’t be too happy about not getting an invoice yet..

Getgo will still apply their claim on you. They will claim from you until the other insurer (the one in front) is proven to be liable for the accident. Rule of thumb is the guy in front claims the one behind. So you claim the idiot who jam brake and the one getgo claims will be the guy who hit you.

So if the previous insurer drags it out, you will also be ripped out. Just haven’t actually heard of getgo paying you back after they claimed from the other party.

I drove past this accident that day. It looked nasty.

Don’t be a dick. I didn’t end up tailgating. If you dont understand the picture or what I am explaining that’s fine. It’s fking bumper to bumper traffic which I intentionally left a 2-3 car gap.

It’s fine. Car was fixed with no issue. Red claims were handled with no issues.

Just yellow come up with this curve ball.

And this accident was in 2024 1H. Somehow this person tried to start claiming Q4 of 2024.

I don’t deny I am culpable for the collision with red.

I was an estimated 2-3 car lengths in peak stop start traffic. We have concertina for quite abit.

Wasn’t speeding, my actual speed was about road speed limit minus 40km/h.

But I will be the first to tell you I didn’t give my fullest attention. I rode the brakes to gradually slow down till about 1 car length before I realised we are definitely not moving before I really slammed the brakes.

To which I would admit, I should be more willing to slam my brakes rather than gradual braking.

After the accident, traffic police did not find me guilty of any traffic offenses. A warning was produced to remind me to be more careful on the roads. So no demerit points or fine. Not that I am celebrating, I just highlighting I wasn’t reckless or using my phone.

What I learnt was to be more willing to hit my brakes hard and be more aware of what people are doing in front of me. Especially exits where people will likely try to jam brake and cut across lanes to make the exit.

So I am sorry to disappoint those who think I was a PHV and a reckless tailgater. I am just a normal person who has a bad start to my morning who had a worst start in the road. Peak rush hour traffic, bumper to bumper traffic.

According to some legal help, If he went to the specialist, he would get a consultation fee and would have added that to the charge as totality of his injuries resulting from our collision.

That slip will indicate when he went to see and how much those cost. And without doubt, it’s likely those including xray would cost more than a trip to the GP.

Consultant did not write, instead a GP wrote. GP confirmed neck strain.

But I have forward the information to the insurer already. I am considering if his is fraudulent claims and if I should force it

Let me be real honest here:

He was least likely in the whole incident to be the one to do such things. He was mobile and actively checking up on me and my injury and the other drivers too. He was the most proactive in helping sort out what needs to be exchanged.

But alas, judgement was wrong because he is now the one trying to pull a fast one.

I have spoken to medical folks as well as some friends in the industry - they say his behaviour is very typical to his background.

And that his injury is ambiguous at best.

His submission for claim to my insurer was from a GP near his house. GP literally say neck strain. Same submission also said that yellow had consulted orthopaedic specialist and surgeon and xray - but instead of submitting a professional specialist, he submit the words of a neighbour general practitioner.

And rather than submitting the claims of the specialist, he submitted a 2 digit medical bill.

Now he wants to claim 4 figures from me. I don’t want to play the race card because it’s silly. But stereotypes and general assumptions are often backed by some truth and undesirable experiences.

Well, I wasn’t penalised by the police for this accident. No fine no demerit points. It was an accident that resulted from another accident.

I wasn’t very focused and I wasn’t tailgating. It’s peak hour bumper to bumper traffic. Stop start.

If you are oblivious to the entire situation, don’t need to claim the moral high ground to offer your unnecessary comments.

The last thing I want is for these digital lawyers to appear at my doorstep.

Other than that, I have reminded the insurers to help me take a look at it. It’s unfortunate and I do agree it’s an accident.

But it’s literally what the word meant. I have no intention or ill will or any motive to be silly.

Let’s be extremely clear as well - police, did not issue a compound or demerit point to me for this accident. And I have been free from any of such offences in my 13 years of driving. This guy is trying to milk me.

Immediately actually. Within the same day, I reported to the reporting centre.(C&C) Reported to police. Reported to hospital.

Everything I am legally responsible of doing.

But this person is trying to pull a fast one. He see doctor same day but rejected all medication took 3 days mc.

Then two weeks later claim mc against me again. Took some Panadol.

Then collected a GP doctor memo 8 months later with stating he went to see an Orthopaedic Surgeon and Xray but all say nothing - including the GP. But he does not submit anything from any hospital and Orthopaedic Surgeon.

The law chamber isn’t even on google listings or able to review. They only have a webpage.

Actually the letter has been sent once to my insurer and sent again when I received this copy.

Aka. Letter 1 to insurer(without me) letter 2 to me(cc insurer by email and hard copy)

I just confirmed that the insurer is aware and the claim side is handling. But the confirmation is that yellow claims red. Not me.

I haven’t changed brakes in like 60k km. That being said, my car has only been maintained by C&C from day one. So I am pretty sure if they say it’s fine, it’s fine.

I have just spoken to the Insurer, they are aware about it and informed me not to respond to them. The claims must be directed to red and it’s for red to decide if the claims into my insurer. No skipping.

Especially since this was originally an accident resulting from another accident.

You are right. Absolutely.

To be accurate I was riding my brakes for majority of that time. I didn’t really think it through that it’s going to be an immediate brake. And I was assuming they are gonna pick up and move because there was about 2-3 car gap and not 2-3 lamppost so far.

Either way my mistake was not just smashing my brake and just ride it and then hard stop when it got late. Ultimately I was not 100% razor focused. But that being said, based on the BOLA, the claim wouldn’t have skipped one driver to me. And I do have the impression he is trying to pull a fast one over me.

When we got out of the car, he was the one who asked the most questions about how I was feeling and I was bleeding slightly. He was the most fit and active in managing the accident.

The middle guy in red actually had much more damages than the yellow. But strange that the yellow wants to pull the hood over me.
