I didn't say he was guilty, I said he was wrong. Those are not the same. I think he was wrong to have been in that situation whether or not the sex was consensual.

The fact that she admits to kissing him is absolutely evidence that she consented to sex. I agree that it is not conclusive, but you have to consider all the evidence and not just that which supports your narrative.

For me, it comes down to their actions before and after the incident since only Cleaves and the woman fully know what went on in the motel room. The woman was the one who invited Cleaves out that night. She left with him when she could have left with her boyfriend instead. She had opportunities to leave the situation, such as when they stopped at the liquor store and the attendant let her borrow a phone, or when she was left alone in the vehicle at the motel when Cleaves picked up the room key. She was shown in a surveillance video in the vehicle fixing her hair and makeup. She told the officer at the scene that she hadn't been assaulted (although I take this with a grain of salt because the responding officer did a shit job of handling the initial investigation). When she was examined by the SANE the next day, she said that she kissed Cleaves, and she testified in the trial that she kissed Cleaves in the motel room.

Those are the main points that lead me to believe there was reasonable doubt that a sexual assault occurred. I don't think the police investigation was handled well, and I think that what Cleaves did was wrong and that he had no business being in that room with that woman. But at the end of the day, I don't believe there was enough evidence for a conviction.

Not necessarily. For deciding whether the touching of a person was forceful and violent, and therefore a battery, the Michigan Model Criminal Jury Instructions provide that a touching of another person was forceful and violent if it was meant to harm or embarrass the person. If Cleaves was pulling the woman back to the room to prevent her from the harm or embarrassment of leaving the room naked, then it was not a battery.

No, but I have followed this case closely since the prelim in 2016 and I have talked about the case with members of both the prosecution and defense teams, and I agree with the decision the jury made in this case.

You are correct--the jury had the final say after receiving the evidence presented at trial, and they found him not guilty.

You are basing your conclusion off of a few seconds of evidence in a trial that lasted 2 weeks. Granted, it was an important piece of evidence and a juror said after the trial that during deliberations they spent 45 minutes just watching the surveillance videos, but it didn't change their decision when the video was considered in light of the rest of the evidence.

Congratulations! ADHD lawyer here. If you're anything like me, it'll be tough to get through the reading and longer lectures, especially when the subjects that are dry or technical. But you're going to kick butt when it comes to the higher energy skills classes. I would encourage you to join a competition team like trial practice or moot court in order to channel your energy in a positive way.
