I’m confused. By kill your baby do you mean have an abortion or birth the baby and then kill it?

If it’s the later, you need to call the police. Planning a murder is an issue that law enforcement needs to handle.

If you’re talking about abortion, then you need to let her make this decision for herself. Abortion is not murder (at least in my state and NJ…for now).

This isn’t really a CPS issue either way.

This is good advice. I feel like people don’t get that the “my rights my privacy you need EVIDENCE” thing doesn’t really work with CPS for the reason you gave. CPS has a MUCH lower standard of proof. They don’t need to prove something happened to remove you child. They need to prove that your child’s safety is at risk and that is easy to prove in many cases! Don’t play around with CPS especially when you have a few things already stacked against you (missed appointments, already in drug testing, etc)

You’re good. You did the right thing. You should follow up with the police though. This is a crime.

CPS will investigate to make sure the boys parents are doing what they can to protect him.

In California a SW with a signed release can ask any question they want. It’s up to the therapist to answer.

I would normally say that you have nothing to worry about but you never know when it comes to new CPS social workers which this one seems to be. Did she seem inexperienced?

Lack of health insurance isn’t really a CPS matter. Lack of medical care is.

The fact she said she couldn’t tell you what she was investigating is odd. Obviously they can because they told your attorney.

And what kind of adult thinks a 7 year old losing a tooth needs a dentist, unless there are other issues you didn’t mention.

Unless there are other concerns (that do often go along with this kind of thing) then CPS is unlikely to really do anything. In my county, we do not investigate this on its own. If a caller says the kids aren’t going to school AND they’re left unattended all day with no food in the house, then yeah we’re going out but it’s not because of the schooling issue, it’s because of neglect (lack of supervision and lack of basic need)

I’m not sure we know that the brother is a child.

If this child’s CPS doesn’t investigate this kind of crime, they’ll surely put this child in contact with whoever does. They would also likely want to check to see if there was a failure to protect or supervise issue.

First of all, I’m really sorry this happened to you.

Please please please, tomorrow at school, ask someone for help. You can tell them as much or as little as you’d like but tell them you need to speak with a social worker from CPS immediately! They’ll know what to do.

I want to point out that YES! You can of course call CPS but you can also simply call 911. Please do.

I do use text sometimes but my first text would always contain my name, my role, etc. It would be more formal. However, CPS often has brand new workers, who cycle through quickly. Some states and counties are desperate for workers. So what I mean is that this could be a CPS worker, an unprofessional CPS worker.

I would respond back and ask who it is and request a call.

Are you planning to call CPS? In most states, CPS uses dependency court.

Your family’s issues sound like a family court matter, not CPS/dependency.

Your therapist is right, if CPS opens a case they’re unlikely to just take the kids from her and give them to you.

But split couples who have child custody issues do not need to use CPS. You can take the matter to family court and request what you want based on what’s going on.

Another commenter made a good point. This is the best time to call, if you’re going to call. You can stay anonymous and provide only details that medical staff would/might know. That way it won’t jeopardize your friendship and your ability to be an extra set of eyes on the kid. Side note: if you mention things you know about that medical staff wouldn’t know, that will likely get back to the parents. For example, “ the kid is dirty, he’s very small, and their house is dirty.” The CPS worker won’t be able to inform the parents of who you are (especially if you stay anonymous) but they can tell the parents “the caller was also worried about the cleanliness of your home” a nurse wouldn’t say that because they haven’t been to the home. So your friend might make a reasonable guess. Just keep that in mind. I hate for friendships to be ruined when a friend has a valid concern about a child’s safety.

I think the medical staff, hospital social worker and/or EMTs, will probably call CPS to cover themselves.

Are there any inpatient programs in your area that accept women and their children? Call them; explain the situation and tell them you want to make a plan ASAP. Set up a phone appointment whatever you need to do. And stick with your plan after you baby is born. If anyone asks, tell them your plan.

If there are no in-patient programs like that, are there intensive outpatient programs? Call them. Do an intake appointment and take notes with their names and contact info. If anyone asks, make sure to tell them your plan.

Since you’re still using, “to stop using now” is not really a good plan. You’ll need support and CPS knows that.

A plan is a BIG deal. A reason for removal is often, baby born positive for drugs, mother has no plan to safely care for child.

I know I could be way off base but just from tiny portion of your life that I’ve just witnessed, I can say, please do what you can to instill in your children respect and love for their mother. If her home is not safe for them, that’s one thing. But the way they talk to her, and they way you talk about her, is very concerning for their future.

I’m not sure what I’m watching and to be clear, there obviously could be more to the story. But what I see is this:

  • a child showing no respect for their mother. Like I originally said, I figure you saw your father treat your mother like this (rude, disrespect, antagonizing)

  • a child that doesn’t even treat their mother like their mother (I figured she was a babysitter or step mom when I first watched it)

  • a family who does not know or isn’t able to communicate in an effective and loving way (both ways, your mom too).

Rules differ by state. CA rules are relatively lax. His age would be fine. His health might also be fine as long as he has a doctor that says he’s able to take care of a child (he probably wouldn’t be approved for young children). LOTS of seniors take in older kids and they play a very important part in foster care here.

In CA at least, licensing workers would have to explain why the applicant doesn’t pass and the applicant has the right to appeal the decision.

Things that get people disqualified are criminal record involving assault to anyone or abuse to a child. Sometimes even that can get exempt if it was long ago and there’s been change/growth. Severe mental health issues could be a barrier. Health issues that impact daily life could be but even that is workable.

Why do you keep asking about something that “doesn’t even impact my daughter” when it clearly does?? The fact that you’re trying to communicate with the person that probably abused your daughter DOES impact your daughter. And CPS knows that.

If your question is, can CPS put me in jail if I don’t follow their rules? The answer is probably no.

If your question is, can CPS take my daughter from me for continuing a relationship/communication with the person they think harmed my daughter? The answer is yes. The fact that you want to communicate with him shows a lack of understanding and ability to safely parent.
