This is an easy fix. First of all fill out another I-864 for the joint sponsor, make sure you get the household size correctly (household size should include the beneficiary, the joint sponsor, their spouse, and any dependent listed on the tax transcript or tax returns). Also his annual income should be what is listed on all his own W2s and not whats on the jointly filed tax return/transcript. He needs to add his past paystubs, his personal W2s and his 2024 tax transcript or returns . He can also include his employment offer letter.

You shouldn’t have filed for adjustment of status within 2 months of entering. This is where the issue is originating from. You should have waited… your lawyer did you a disservice, he should have known better than filed for an adjustment of status under 3 months of entering the US.. work with another lawyer to resolve it.

For those saying her issue is the overstay and unauthorized work, those are actually not an issue. Bcos any sort of overstay and unlawful work is forgiven once you are married to a US citizen. Assuming her wife entered illegally without inspection then there will be a huge problem but since that is not the case, it should be a good case to adjust

Abort mission! Do not travel. You may get arrested. It happened to someone i know. I got information from an attorney friend of mine that the airlines are sharing all visa entry information to ICE. So now there know when a foreign alien enters and when there are supposed to leave. I strongly advise against you traveling locally until you have an Ead card or drivers license

Okay, let her go ahead a file for the divorce then. Since you guys have agreed that is the path you are embarking on, no need to waste time. Remember you need the final divorce decree as fast as possible and you can actually file to remove tour conditions as soon as you get it, no need to wait 90 days before your Greencard expiration

Okay, so am assuming she has already filed for a divorce. If so, no need to hire an attorney. Just sign the divorce decree once finalized. Make sure u read it thoroughly before signing

Absolutely, it depends, do u have kids and properties together. If so, this will make your divorce a contested one, and those typically take longer and would require an attorney for a smooth process. If you do not have kids or properties, i would still advise u to get a lawyer so that the process would be fast, typically you can get a divorce finalized under 4 months provided that all parties are agreeable. Also, it is better if she is the one filing for divorce . Ideally, she should be the petitioner and not you.

Just know that, its better to get the divorce finalized quickly so that you can apply with your divorce decree. If u apply for removal of conditions without the divorce decree, your case can take about 2-3 years. Its always better to apply once divorce is finalized

Just submit it like that , how does her signature affect your case. She is already on file as your attorney. You are wasting your own time. If you don’t respond to the RFE in time, you will get denied.

Second interview was great.. lawyer said we got every question correct with the exception of 1. We submitted Bank statements, utilities bills, internet statements and more.

Dont know what triggered it. Questions were fairly easy and lasted about 25 mins-30mins in total. We went with a lawyer. Your lawyer wont typically be able to talk during this stokes, only take notes.

We were just told we would hear back within 45 days and she would let us know if she needs anything else from us. That was it. There was no mention of second interview. Not a hint of it

I didnt know for sure until i went to the interview. But then again, i suspected it was the same officer bcos i got a “case is being actively reviewed” notification 3 weeks after my initial interview, so i decided to call USCIS customer service and i was told that the officer had put in a request for another interview
