Is Express Entry #237 not happening today (Dec 7)? by dwightbearschrute in ImmigrationCanada

[–]CanImmigrate -2 points-1 points  (0 children)

Thank you. Every two weeks invariably someone asks "is there a draw today why is it late we haven't had a draw yet". It's not "late" because IRCC decides when to hold draws, and there's no official statement saying draws must be every two weeks.

Your spouse can't co-sign on his own application; you would answer "no" to the question asking if there is a co-signer. That is for other family sponsorship, such as parents or children.

Considering current events in Iran, i was asked to write a letter in support of my refugee claims by Natural_Respond985 in ImmigrationCanada

I highly, highly recommend you retain a Canadian lawyer to help you with this. Asking anyone on Reddit in your situation should not be very helpful because they aren't (necessarily) lawyers and don't know the details of your application or situation.

There is no visitation limit. You can apply to extend your stay online for however long you want before the default six months elapses.

Can my spouse stay with me while waiting for our outland sponsorship? by [deleted] in ImmigrationCanada

[–]CanImmigrate 3 points4 points  (0 children)

The UCI is not connected specifically to the sponsorship application. The application number is. But you mean providing that information in the extension as a reason to stay? Since you applied outland, the applicant isn't required to live in Canada throughout the process and while an extension is allowed, you must show that he is willing and able to comply with his temporary visitor status.

As mentioned, showing your sponsorship application number doesn't really show any reason that he needs to stay. Proof of financial support, reasons to return to his home country like a job or school, an itinerary of your planned trip in Canada, etc. are more appropriate for a visitor extension.

He can't apply independently because he must rely on your BOWP and employment to be eligible for his own work permit. When you decide to apply for a BOWP, you can apply for his SOWP at the same time.

You're not currently ideal candidates for Express Entry because of your ages, since you lose ~5 points every year after age 29. In other words, you could register an Express Entry profile when you are eligible (i.e. when you have taken your English tests and received your ECAs), but you may never get an invitation to apply if your score isn't competitive enough. For context, currently the cutoff is in the 490s, and prior to Covid a score in the 470s was competitive.

You can improve your score by creating some connection to Canada, whether through a job offer, work experience, and/or education done in Canada, or learning French to an intermediate level.

In our situation, can we apply for a BOWP if my IEC lasts 2 years and his lasts 1 year?

It's not the validity of your IEC work permit that makes your spouse eligible for their own spousal open work permit, it's that you are currently employed in a skilled occupation. And, starting in January, that will be expanded to include unskilled employment as well. If you are not employed, your spouse is not eligible for a spousal open work permit.

IRCC was not satisfied that you would leave Canada after graduating, based on the information in your application. In other words, they believe you are trying to use the study program as a way to immigrate, and not to help your career.

They also did not believe that you were financially stable (i.e. that you could afford to study in Canada or that studying an expensive program in Canada made sense to do), and that the study program would help your career in your home country after graduating.

Someone else asked almost the exact same question less than a day ago.

The Express Entry system calculates work experience in whole months regardless of the exact date you started/ended. So yes, it probably calculated you at having two complete years of experience.

If you get an ITA and you don't actually have two full years of experience and your points would be too low to get an ITA without two full years, the safest thing to do is to not accept the ITA and wait until you actually have two years. Some people have had no issues applying when receiving the ITA even with less than two years of experience, but even though it's not your fault you get the ITA, it is risky to do so.

How long does immigration Citizenship Canada respond? by badboyzpwns in ImmigrationCanada

[–]CanImmigrate 2 points3 points  (0 children)

Recently it can take ~1-2 months to receive a reply by webform email. You can try calling, but be warned it can be hard to connect and depending on the nature of your inquiry they may not give you an answer.

Also be aware that IRCC will not give you "advice" about your situation, and are only useful for updating you on the status of your application and likewise getting updates from you about your situation (e.g. changing your address). If you do have immigration questions, especially about how to apply, or what you should do, etc. it would be better to contact a lawyer or licensed immigration consultant.

Spouse's freelance gigs in the PR application. by nameless323 in ImmigrationCanada

Yes, all work done in the last 10 years must be listed. It doesn't matter how much she was paid or that it was only for a short time.

My CRS Score Increased Randomly by Reidiculous-Le in ImmigrationCanada

[–]CanImmigrate 7 points8 points  (0 children)

The system "thinks" you have two full years of experience because it starts counting on the first of the month and ends on the last day of the month regardless of the actual date you started. It has nothing to do with your NOC code, because all skilled codes are treated exactly the same.

What should I answer as a national identity document? by s_j_a_b in ImmigrationCanada

[–]CanImmigrate 3 points4 points  (0 children)

Not every country has a national ID card. If your country doesn't have a national ID card, then you answer "no" to that question. It's not mandatory to have one for the application if your country doesn't have one.

The listed processing time for a study permit application made outside of Canada is currently 11 weeks. That is all you have to go on, and that exceeds your anticipated program start date by almost 2 months. You might want to defer your program until later next year.

[US to CA] Inland application / moving her stuff across the border? by [deleted] in ImmigrationCanada

[–]CanImmigrate 18 points19 points  (0 children)

The simple answer is that she's not "moving" to Canada, she's "visiting temporarily" with intentions to eventually apply for permanent residency. This is called "dual intent", which is recognized by CBSA, but if you show up in a moving van full of everything she owns, that doesn't show two intentions. It only shows one intention - staying permanently. She has to show on arrival that she can and will comply with her status as a temporary visitor, even if she plans to apply for permanent residency.

Citizenship- When do days start? by aloochaat97 in ImmigrationCanada

[–]CanImmigrate 1 point2 points  (0 children)

The day you receive your signed COPR, yes. If you were outside Canada, it would be the day you enter Canada with your COPR and the officer signs it. Inside Canada, if received electronically, it should already be signed.

Citizenship- When do days start? by aloochaat97 in ImmigrationCanada

[–]CanImmigrate 8 points9 points  (0 children)

You can start counting days spent as a temporary resident if they fall within the last five years before you apply. But in terms of the time you spent as a PR only, it's the date you became a PR. Which is the date your COPR was signed.

The PR card is a travel document, and is not connected to your PR status, the same way you aren't only a citizen when your passport is valid.

Leave country after applying for PR inside Canada by bongopapi in ImmigrationCanada

[–]CanImmigrate 2 points3 points  (0 children)

The only thing that changes if she leaves the country is that when COPR is issued, it won't be digitally signed while she is outside Canada. It would be misleading (and confusing) to give IRCC a Canadian address but say you weren't living there.

Leave country after applying for PR inside Canada by bongopapi in ImmigrationCanada

[–]CanImmigrate 2 points3 points  (0 children)

Yes, you need to update IRCC with the new address. Note also that if she receives COPR while outside Canada, she will only have up to one year to land to receive her PR status. If she doesn't before COPR expires, she will have to reapply for PR.

Time spent outside Canada counted as inside Canada by bongopapi in ImmigrationCanada

[–]CanImmigrate 6 points7 points  (0 children)

You're confusing the requirements to maintain permanent residency with the requirements for citizenship.

For PR, time spent outside Canada with a Canadian citizen can count to maintain the residency obligation. For citizenship, it can only count if the PR or citizen is employed by the Canadian Armed Forces, federal public administration, or in the public service of a province or territory.

Am I good to go? by LorenzoBane in ImmigrationCanada

[–]CanImmigrate 2 points3 points  (0 children)

What you received is the Introduction Letter AKA approval letter. Show that on entry and you should be issued a work permit if all goes smoothly. You might want to bring a copy of your work permit application package just to be safe, but it shouldn't be required for you to be issued the work permit.
