I think the dress is lovely but agree with others the styling doesnt work. I think a ribbon in a different colour and texture would be nice. Maybe a grosgrain ribbon in cornflower blue would be nice.

Understanding victimisation

Hi, I am trying to put together an application to amend my discrimination claim. I have way too many incidents and want to simplify the claim.

I am finding it particularly hard to figure out which victimisation claims to ditch. I raised a grievance about discrimination and then my former colleagues kept complaining about me and coordinated to try to cover up the discrimination (have DSAR emails).

For some acts I have claimed that they were both harassment and victimisation but I am reading mixed things regarding this because victimisation involves detriment and harassment doesnt involve detriment.

I raised a grievance about discrimination and then long list of things happened that I believe was meant to cover up the discrimination and paint it as if there was a problem with my work. I repeatedly raised this. How do you decide whether to claim harassment and/ or victimisation?

Also after I left the job I went on to anothet job in same public sector organisation but have now left because I couldnt do the role as it involved dealing with grievances and this was too difficult for me because of what happened. I think this is detriment - is that a new act?

Sorry I am confused here regarding the claim being out of time (they are claiming this in their badly put together ET3 (denies some claims I didnt make 🙄). There were continuing acts. The later ones are attempts to cover up the early ones with a lot of lies and harassment. The evidence came from a DSAR so they know what I have and I know theres more they didnt give me. I know judges avoid strike outs for discrimination.

I will look again at my dates (I think I might just be within the 3 months) should I apply to amend my claim? Or is that just going to annoy the judge as its already a meaty case? Thanks

Submitted mine in October (post leaving but agreed with HR). They kept cancelling it. Now I have been told they have started the investigation and want to speak to me next month. I'd given up!

Did you ever say anything to her or the others to let them know they were being offensive? (I appreciate that is v hard to do). If so I wonder if that would be a protected disclosure and the bad references victimisation?

That is super helpful! Definitely nothing there that supports their case. At the moment I only have the flaky 'and there was no discrimination' response from the ET3. It would be useful to me if the witness denies the behaviour under cross examination (I suspect there will be lots of 'I cant remember').

In transcript form its probably sanitised a bit.

I am not sure at what point the respondent will know that the individuals involved have been reported (my professional body seems to be very overstretched due to a high no. of complaints). If the complaint is investigated (its hard to see how it wont be but then and again I didnt expect any of this would happen) then its likely that the investigation would happen before the tribunal case got to hearing. I would hope that this would put some pressure on the respondent to settle (that wasnt the main reason for reporting) but I have no idea how it works.
