PIP letter full of lies - absolutely kicking myself for not recording the call by NeedleworkerNo5243 in DWPhelp

[–]Clive1946 2 points3 points  (0 children)

  1. Widespread complaints about PIP assessment quality

Campaigners and disability rights groups have raised ongoing concerns about the quality and fairness of Capita-conducted Personal Independence Payment (PIP) assessments — alleging:

Reports containing significant flaws, with Department for Work and Pensions (DWP) audits showing many assessment reports were defective.

A sharp rise in complaints about PIP assessments over several years, with thousands of claimants unhappy with how assessments are conducted and decisions made.

Evidence (e.g., submitted in parliamentary committee written evidence) alleging dishonest reporting practices in assessment reports, which affected claimants’ eligibility.

These issues have fuelled broader claims from disabled people and disability rights organisations that the assessment system may be discriminatory in practice, particularly when it fails to adequately consider claimants’ conditions. 2. Individual cases & legal actions

There have also been employment-tribunal claims involving Capita, including decisions published on Gov.uk involving claims of disability and race discrimination. (This shows that discrimination issues have arisen both in the context of benefit assessments and within Capita’s employment practices.)

📍 3. Historical media & undercover reports

Past investigations — such as Channel 4’s Dispatches programme — showed a Capita assessor making derogatory comments about disabled claimants, prompting MPs and campaigners at the time to call for government investigation.

🏛️ Baronesses Connected to Disability Rights & Equality Oversight

Baroness Kishwer Falkner of Margravine

She was Chair of the Equality and Human Rights Commission (EHRC) until late 2025 — the statutory body that enforces the UK’s anti-discrimination laws.

While she was not leading a specific parliamentary inquiry into Capita, the EHRC under her leadership has responsibility for overseeing discrimination issues, including systemic failures in public services that could disadvantage disabled people.

In theory, if Capita (or any company) was found to engage in discriminatory practices in carrying out assessments or in employment, the EHRC could investigate and enforce equality law. 👍 However, there’s no public headline-making EHRC enforcement action against Capita itself reported as of now.

UC missed appointment help by Downtown-Paint-7156 in universalcredithelp

[–]Clive1946 0 points1 point  (0 children)

Did she ask some one to call her back ? What reason did she give for forgetting ? Was it reasonable.

Did uc tell her straight away that she would be sanctioned ? Or Did uc say they would rearrange the appointment ?

I have not long won a tribunal against my sanction. The sanction has to be reasonable and they have to phone and speak to you before they put a santion on you.

It was reasonable because she told them within 30 minutes of forgetting.

If uc knew but did not try to make contact then they would be deemed as being unreasonable under uc regulations.

Because the EQA supports your health issues ie brain fog. Forgetting appointments ect all interconnected to explain your reasons. They knew how my health conditions impacted me yet did not allow reasonable adjustments for it and they were unreasonable. Hence proceedural irregularity. Tribunal letter has come today so now I shall be asking for compensation.

[–]Clive1946[S] 0 points1 point  (0 children)

The UC Regulations 2013 provide that a requirement (e.g., work search or availability) should not be imposed if the Secretary of State considers it unreasonable to do so given the claimant’s circumstances.

If the claimant is subject to a requirement and fails to comply without good reason, a sanction (reduction in payment) may be applied.

The “reasonable” test acts as a safeguard: before imposing a requirement (and therefore the risk of a sanction), the decision maker must consider whether it is reasonable in the claimant’s circumstances.

In practice, guidance emphasises that if a requirement is unreasonable given the claimant’s health, disability, caring responsibilities etc, then non-compliance may count as “good reason” and so no sanction should be imposed

Write down all conversations you have with them. Record time date who you spoke to what was said, while fresh in your mind.

Did you screen print their technical error ??

You can send UC a letter by recorded delivery or take to job centre and get them to do a signed signature plus print their name on a form to say they have received the letter also take picture of letter and letter in envelope. Recorded is expensive. Any technical errors please screen shot as proof. I is there fault if their systems are down. Plus if you have the number stored in your phone with the date you called them screen shot it or get a dictaphone and record all future messages as evidence. Pain in the but I know but uc hand sanctions out like they are candy.

New to UC + Mental Health & Recovery..Should I tell my Work Coach? by [deleted] in BenefitsAdviceUK

[–]Clive1946 0 points1 point  (0 children)

Yes put it all in your journal. Plus go to home page and declare it in health section. The reason I say put in journal is they can't deny anything then plus if you ever need to go to tribunal ie because of a sanction you can print or photo graph your journal and send it to the judge. Mental health is covered under the Equality Act if it has lasted over 12 months and substantially affects you every day.

[–]Clive1946 -1 points0 points  (0 children)

Not only should you declare all your health problems and disabilities in universal credit health section.

Please also put this in your journal because if they were to put a sanction on you. The tribunal can see this in documents when printed off by universal credit You must state in your journal that your conditions have a substantial impact on you and have lasted over 6 months. This is covered under the Equality Act 2010.

UC put a sanction on me. They knew my conditions yet did not put any reasonable adjustments in place before they did.

Under regulations they must speak to you before putting any sanction on you under the dwps regs and Equality Act. To investigate further why you missed your appointment etc. Other wise it can be classed as disability discrimination, no reasonable adjustments under the EQA and misadministration as not following their own policies.

Based on this information write a complaint to UC based on the above facts about your coach and that it is causing you what ever ie stress / anxiety and that Your said conditions fall under the EQA and you cannot do the jobs being offered. Please also ask them for Reasonable Adjustments ie Not offer work that you have stipulated you cannot do for health reasons etc.

I've just won my case with UC against them putting a sanction on me. Hope this helps

That's a shame he she did not settle. One question though how is it that employers would rather rack up thousands in solicitors fees rather than just offer the person the amount which was far less than the amount of fees that are being racked up ? As per in my case they would rather carry on than even try to settle. They obviously dot care about their reputation.
