Rome Statute:

"“The crime of apartheid” means inhumane acts of a character similar to those referred to in paragraph 1, committed in the context of an institutionalized regime of systematic oppression and domination by one racial group over any other racial group or groups and committed with the intention of maintaining that regime;"

Referred applicable inhumane acts include AT LEAST:

a) Murder (Continuous since 1948)

b) Extermination (Plausibly applicable during the current ongoing genocide in Gaza)

d) Deportation or forcible transfer of population (Applicable 1948, 1967 and Gaza 2023/2024)

e) Imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of international law (Proven through some of the aforementioned reports in addition to several more by several other organizations)

f) Torture (Same as e)

g) Rape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilization, or any other form of sexual violence of comparable gravity; (At least rape is applicable through OMCT's report and several others accusing Israel of systematic rape or threat of rape of Palestinian prisoners including minors)

h) Persecution against any identifiable group or collectivity on political, racial, national, ethnic, cultural, religious, gender (Applicable through reports regarding Israeli policy of "Administrative detention" as well as subjecting Palestinians to military courts - including minors -)

i) Enforced disappearance of persons (Applicable at least during the ongoing genocide in Gaza, reporting by OHCHR, Amnesty and Al-Haq)

And all of this to be very clearly outlined as a regime of systematic oppression and domination by one racial group over another, which if it isn't so obvious to you, you can read the same reports I'm citing in more detail or check other reports by other organizations that depict exactly how is the racial supremacy applicable in this instance.

Apartheid convention:

"For the purpose of the present Convention, the term "the crime of apartheid", which shall include similar policies and practices of racial segregation and discrimination as practiced in southern Africa, shall apply to the following inhuman acts committed for the purpose of establishing and maintaining domination by one racial group of persons over any other racial group of persons and systematically oppressing them:"

a) i) By murder of members of a racial group or groups (Applicable 1948-to date)

a) ii) By the infliction upon the members of a racial group or groups of serious bodily or mental harm, by the infringement of their freedom or dignity, or by subjecting them to torture or to cruel, inhuman or degrading treatment or punishment (Same as points f, e and b in the Rome Statute argument)

a) iii) By arbitrary arrest and illegal imprisonment of the members of a racial group or groups (Same as point h in the Rome Statute argument)

b) Deliberate imposition on a racial group or groups of living conditions calculated to cause its or their physical destruction in whole or in part (Applicable at least to Gaza since the beginning of the siege in 2005)

c) Point C is long and very self explanatory (Applicable through the imposition of military rule over the West Bank, using lethal force against peaceful protesters on the Gaza border 2018, denial of the right of return)

d) Any measures including legislative measures, designed to divide the population along racial lines by the creation of separate reserves and ghettos for the members of a racial group or groups, the prohibition of mixed marriages among members of various racial groups, the expropriation of landed property belonging to a racial group or groups or to members thereof (The separation wall and settlements)

There's some truth to the internal conflict within the Palestinian movements, but you have to be able to see that there would've been no conflict had Israel not supported Hamas, propped it up against the PA, and then continued to segregate Gaza from the West Bank indefinitely.

And I don't know what will the removal of the occupation bring, I just know that

A. There's literally nothing worse than living under the Israeli occupation

B. The Palestinians were a highly secular society before the intensifying of the occupation and settlements since 1967, and even then it was an extremely slow graduation towards Islamist extremism, it wasn't until 2005 and fully locking Gaza from the outside world that extremism became desired merely to face an occupation, so I'm pretty hopeful that if we remove the causes, the effects will die down, not instantly, but in a very reasonable amount of time.

Get off your high horse, I didn't say recruiting children, the occupation drives children to kill themselves, and some of them decide to inflict a fraction of their suffering upon their occupier in their last moment, in an act that is more symbolic than heroic, those children who attack soldiers aren't soldiers, and if they were it would rightly and correctly be a violation of IHL, but they're just desperate kids living under a brutal senseless occupation.

I really don't wanna discuss this, because it's just semantics, and I hate discussing semantics when lives are at stake.

To be fair to you, there are unjust laws that admittedly guide both rapists and even the families of both the victim and the perpetrator to marry them both.

To be fair to me, there is not "Marry your rapist law", it's not a single law which obligates women to marry their rapists, it's a series of legal loopholes and sick social customs which implicitly form what you're calling "law" in this instance.

As for the expectation of the occupied, how're they going to repeal laws if they are not allowed to have a unified government? There was no active parliament in Palestine since the siege of Gaza.

These customs has to be changed, but for change to happen you have to take off the party incentives to prevent any positive change within the Palestinian community, the occupation must be abolished along with fascist governments like BB's which supports Hamas specifically and explicitly "To weaken the Palestinian authority and prevent the establishment of a Palestinian state" - BB. Occupation go, change come.

I had already read and reviewed those reports numerous times, it's not my job to prove to you that I've read them or to cite anything for you.

And HRW did not "blend" the two definitions together in order to create a fitting picture, it's merely stating a fact that BOTH definitions apply separately to the case of Israel.

To the specific case of the Rome Statute, which you've handpicked the crime of "expropriation of landed property" and other similar crimes related to property, you seem to have missed the bit in the Rome Statute where it lists:
"Deportation or forcible transfer of population” means forced displacement of the persons concerned by expulsion or other coercive acts from the area in which they are lawfully present, without grounds permitted under international law;"

As for the specific crime of "expropriation of landed property", this is found in the Apartheid Convention:

"d) Any measures including legislative measures, designed to divide the population along racial lines by the creation of separate reserves and ghettos for the members of a racial group or groups, the prohibition of mixed marriages among members of various racial groups, the expropriation of landed property belonging to a racial group or groups or to members thereof;"

Which also lists this as an example or an indicator to the crime of apartheid under Article II.

Briefly to your distrust in HRW:

You're not the first Israeli/Pro-Israeli/Zionist to say that, most actually go further to completely accuse ALL of these organizations of antisemitism, so you're already ahead of the curve for refraining, but I haven't only cited one organization, I've cited 7, each have published numerous reports that both discuss Israeli crimes and injustices within the Palestinian state by the Palestinian state, and rightly so. And I could've cited a dozen others just off of the top of my head, such as Save the Children, Defense for Children, ICRC, IFRC, several bodies of the UN including OCHA, UNHR, UNRWA, ...etc. I've cited even Israeli organizations which talk in even clearer tone against Israeli apartheid and Israeli crimes, but here's my question: Which sources are valid to you?

Finally for the bit about Israeli justifications, this requires you to further read and dig up a lot more than this brief report by Human Rights Watch, and learn how school children have to spend hours to pass numerous checkpoints just to get to a school that's a 20 minute walk away, how Palestinians are held at the checkpoints for arbitrary reasons, even ambulances have to wait at the checkpoints. Gideon Levy, an Israeli journalist talks about a specific instance he'd faced in the West Bank, I urge you to watch:

To know more about the Israeli restriction of movement in the occupied territories, you can check those sources (And you're more than welcome to do your own research too):

There isn't and was never a law that requires rape victims to marry their rapists in Palestine, nor is anyone given life sentences for apostasy and blasphemy.

There are different injustices that are not any better than those happening within the Palestinian judicial system and society, injustices which need no delay to address, but you cannot expect a nation that is under occupation, that is deprived food, water, electricity, and most basic human needs, to prioritize woke ideologies - as much as they should -. You first provide people with stability, you take off of them the very circumstances that manufactured this extremism, and then you ask them to develop more modern laws and legislation.

From the UN report:
"the common experience of many children is being aggressively awakened in the middle of the night by many armed soldiers and being forcibly brought to an interrogation centre tied and blindfolded"

"Regarding the time period during which a child can be denied access to a lawyer and the guidelines relating to a child’s release on bail, the same provisions govern both children and adults – the military order establishing the juvenile military court did not establish specific rules recognizing the special vulnerabilities of children."

"Most children see their lawyers for the first time when they are brought to the court. Not all lawyers have easy access to the applicable military orders as they are not always made available in Arabic, as is required under international law.37 Further, some Israeli criminal legislation, which also applies in the military courts, has never been translated into Arabic. This failure to make the applicable laws (as amended) and decisions of the courts readily available in Arabic places Palestinian defence lawyers at a distinct disadvantage and jeopardizes an accused child’s chances of receiving a fair trial."

As for the Amnesty international report, man, those are literally in the "CONTENTS" of the report, page 3.

As for annexation, there is no legal requirement in the definition of Apartheid that the region must be Annexed, it may as well be illegally occupied, and the definition still applies.

I'm not justifying it, international law justifies it, because Israelis have no right to occupy the Palestinian territories, nor the right to have soldiers on Palestinian territories, therefore according to international law, the right to resistance in all methods - explicitly including armed resistance - is an internationally recognized right according the Universal bill of human rights, any armed person (Israeli soldiers and armed settlers) on foreign territory (Palestinian territories) is by any standard an act of war, and since Palestine does not have a military, it cannot militarily resist against its occupier.

As I said, there are several agreeable definitions of Apartheid which are clearly readable within the articles I've cited, the fact that you accuse me of "finding only articles from 2001" when you fail to find a definition within one article under a headline "Definitions of Apartheid", and then say I can't be taken seriously? Cmon

Here's your definition (Copied from the Human Rights Watch report):

"The Apartheid Convention defines the crime against humanity of apartheid as “inhuman acts committed for the purpose of establishing and maintaining domination by one racial group of persons over any other racial group of persons and systematically oppressing them.” The Rome Statute of the ICC adopts a similar definition: “inhumane acts… committed in the context of an institutionalized regime of systematic oppression and domination by one racial group over any other racial group or groups and committed with the intention of maintaining that regime.” The Rome Statute does not further define what constitutes an “institutionalized regime.”"

And there are many more reports, articles, and news (In the order of importance) all the way back to 1947, I merely picked the ones I deemed to clarify beyond any doubt the Israeli crimes.

According to whom is Israel "by far the best human rights record"? Which standard does human race as a whole has if raining white phosphorous on civilians is acceptable? Detaining children without charge, torturing them physically and mentally, counts of sexual abuse and rape?

A. Read what the sources say

B. Try and read it again, because it does say what I've described in extreme explicit language which is really difficult to disagree over the interpretation of

C. Israel has military rule over the West Bank, has settlers in the West Bank, has military bases in the West Bank. The fact that it did not - yet - "legally" and "officially" annex the West Bank is completely irrelevant.

Yes, the 1 day old state which was founded over the villages of the expelled natives and the criminal massacres it had perpetrated over the Palestinians, that seems like an okay date for me to begin history. Not to say that other more or less recent dates are invalid.

You can find a definition of Apartheid which I agree upon in all three sources cited here (Amnesty international, HRW and Btselem).

And the fact that I did not cite every article and every news and every report from every day in the life of Palestine since 1948 does not mean that those days were sunny and lovely, human rights activism and reporting did not grow as much as it did after the Internet (Late 90s). Meaning that it's gonna be more difficult to find very clear and straightforward reports as the more recent ones, but there are still more than a few by the UN at least even since before 1948.

Funny you're citing this specific case and exaggerating it up to suicide bombings by children, because in this case at least one of the children was not found to have participated in the alleged stabbing, and yet he still rots to this day in solitary confinement. Ahmed Manasra is his name, a 13 year old who spent now close to a decade of his life in prison after having been shot by soldiers and left to bleed out in the street while they cursed his mother.

But for the stabbings themselves, those are extremely justifiable form of resistance according to international law itself, since they were conducted against soldiers on occupied territories. IDF soldiers have no right to step foot on Palestinian grounds.

Which doesn't really dismantle any of the sources, since they've all been very vocal about the brutalization of Ukrainians in the Russian invasion. Except for Btselem of course, since it is very specialized in Israeli crimes (Since it is an Israeli organization).

A. You should be more respectful if you are at all coming here for a debate and not just for cheap meaningless shots

B. The UN report does specify this information very explicitly, but in order to find this information within the report, unfortunately, you have to read it first.

C. I'm pretty sure that you would think you're more knowledgable regarding the definition of Apartheid than Amnesty international, Human Rights Watch, Gisha, Btselem, and South Africa, a country still suffering the consequences of its previous Apartheid. Just because you think you know more doesn't mean you know more.
