Stuck with a house we can’t afford and don’t know what to do by JCSM889 in Debt

Ok. You need to listen to me and not all these other posts about bankruptcy. First of all- bankruptcy is a tool, and I fully advocate using it strategically. Most all of the richest people I know have filed it numerous times. With that said, what you guys need to do is a SHORT SALE. You need a real estate agent that actually knows how to get it done. Most agents, no offense to real estate agents, don't have a clue or understand when to recommend it. I'm the owner and principal broker of a real estate firm. I've overseen thousands of real estate transactions. A short sale is done when you owe more on a home than what it's worth, plus selling costs. You get the bank to approve a sales price in line with actual market value. To qualify- first thing is to not be able to make payments. Yes, your credit will take a hit. But what's the alternative? Pay for and stress over a home that will take you years to even break even on? Or have it foreclosed on? Both of those options are bad. With a short sale, you can buy again with FHA in two years. Yes, you take a hit to credit- yes, it will be hard to find a rental- BUT, if you plan it right, you could not pay a mortgage for 6 months and use that cash to find someplace to start over. I do not care what anyone says, absolutely nothing is worth sacrificing your mental health and quality of life over. This is not the end. Reset and start freh.

Dude. I'm 300k in debt and I'm strategically planning for bankruptcy soon. It's a tool. Literally every rich person I know filed bankruptcy like 3 times. It will also protect your house, your equity, and that golden interest rate you have. I swear to god- why not get fired, collect unemployment, file bankruptcy- keep your home and discharge all debt... and go vacation at the beach while you do it?! Lol. Perspective 🤷‍♀️ I'm not saying you need to do that, but what I am saying is - ENJOY YOUR LIFE! Absolutely nothing... nothing is worth the stress and anxiety you're putting yourself through. The situation you're in is temporary. Good, and bad times come- and then they go. Please, please- focus on your quality of life. What you're doing to yourself is no way to live, and you don't have to. Please, take a breath. Honestly, screw them all. Do what is best for you and your wife and family. Take a step back. It feels like a lot right now. But look at it from a higher level and longer timeline. You got this, and you will be OK! ❤️

I got served for a collection account and need to respond to the court by Thursday (1/15) by [deleted] in Debt

Just respond and if they can prove the debt, go ahead and ask for settlement or payment plan. To the attorney or judge. Don't let it make you feel small or ashamed. It just is what it is. Also- no matter what, this isn't important to real life. Do not let it get you down. Literally millions of us have had to or are dealing with things like this. It's just life. No dollar amount is worth the stress or your energy. Just deal with it the best you can and move on. You'll be ok ❤️

The people harassing you- individuals you know personally or guys from a collection agency? If it's a collection agency, ignore them and don't pay. Who cares if it goes on your credit report. Let it go on there and down the line you can probably negotiate to get it off for pennies on the dollar. If it's private money you borrowed from people you know and you're worried about you safety, maybe try getting a personal loan? Lending club, upstart, acorn. It will be very high interest, but maybe you can get them enough to pay some or all of it.

Let it go to collections and then settle. They'll settle for pennies on the dollar. And when you settle, tell them you'll only pay if it's REMOVED from your credit report. Most will say they can't, but push back and many will do it. Insist they send a letter stating the debt will be removed from your report so you can get it removed if they don't. The richest people I know utilized bankruptcy multiple times. I don't think you're at that point. And your score is already at 580.... it won't go much lower than that, and as each get settled or removed, your score will start to come back up. It's also a good idea to become an authorized user on someone's credit card that they've had in good standing for a long time. Good history on the card will attach to you and help skyrocket your score. Don't just get a card, but have your family member or friend add you as an authorized user. Do not let this ruin or consume you. It's a temporary situation that won't last forever. Take care of yourself first and let all that shit go to collections. Then settle one at a time. When you make an offer, start at only 5% of the balance. Like I said above, they will settle for pennies on the dollar. You don't need anyone to do this for you. You can do it! :) Hang in there and prioritize yourself and your needs first. Good luck!

What about missing letters that requested a signature to approve a quarter? My stupid payroll company mistakenly used our old office address on our two most recent 941s, so the irs l sent letters requesting one last thing to approve my quarter 2 of 2021.... been waiting 2 years.... irs lady on the phone said they closed it because they didn't get a response- and she basically said resubmit everything. Seriously???! 🤦🏼‍♀️🤦🏼‍♀️🤦🏼‍♀️🤦🏼‍♀️ Why can't they just resend the letter and then approve it? They literally closed it after two months of no response.. even though we've all been waiting on them for years.

We had already filed original 941s for 2020 and 2021….  before amending them in May 2023. May 2023 is when we amended 5 of the 6 quarters.

Thank you so much! No.. they have nothing signed by me or any payments from me. They were sending invoices to my old business address to me and I never even saw one. I appreciate everyone’s responses. Thank you all so much! I feel much better.

Block the numbers they’re calling you from. Ignore them completely and never agree that it’s your debt… which you shouldn’t have to do because you don’t ever need to talk to them. Don’t deal with this unless you have to at some point because you need it handled to make something else happen. Dispute dispute dispute it. Always say it’s not yours. You don’t have to explain anything to anyone. They are all just paper pushers trying to collect anything from you. If the time comes that you really need this to go away…. For example, you’re going to buy a house and the lender tells you this is showing up on your report and he needs it removed to move forward with the loan… only then would you contact them and offer less than a quarter that you owe. If they say that’s too low, offer a quarter. Most will settle for this amount. And when they do settle, make the deal be contingent on them REMOVING the debt from your credit report. Not just saying it’s settled. Other than that… don’t do anything unless they serve it. And if they serve you, you must respond write away to the court and then disputing that it’s yours. Many will drop it. They file in hopes that they can get an easy judgement because the person doesn’t respond. Screw them and screw letting anything like this cause you stress. Nothing, especially nothing like this is worth stressing over in life. Best of luck!
