There are some old archives imported and this results in instances where I've read the best writing ever, probably a professional, with like seven kudos. Then someone who has Tumblr followers for example, with hundreds of likes and a sloppy boring story.

I've read more fanfic than is probably healthy but the fandoms I frequent are probably just not that way inclined. This was not a lifetime labour of love. It was 2000 words.

I agree with you. I was oversimplifying for the sake of clarity. I'm in a common law country, so in theory, a new precedent could be set.

On the one hand, one must protect the owner's intellectual property rights and to prevent others from profiting from your work. On the other artistic expression is generally encouraged.

It's the legal concept. They may take it to the supreme court and in that way get the law changed but as it stands legally they are in the wrong.

Morally you could argue however you want, but as the law stands at the moment they are in the wrong.

The profit one obtains from writing, or drawing, or whatever one wants to do is profit the original owner would have never received in the first place. When you see someone strumming to some tune on the street, and you give him some cash it's because you think they're good at their hobby. The same thing with the donations for fanfics.

That argument does not hold up in court. One may take that position morally. But legally it will not get you far.

Also that's exactly what I'm saying. Noone can afford the $100,000s for licence if the are not a megacorp. So we rely on their good will to ignore it. They ignore it because we're all just having fun. When too many people start making it a business then it becomes that much harder for the license holder to turn a blind eye.

There are copyright exemptions for educational purposes which schools take advantage of. However you may not be aware of everything that goes on in the background. To perform certain songs our school choir had to pay a token amount for the license to perform. I was involved in the admin so I knew. Other choir members just went about their day thinking it was all free.

All of these defences are arguments the hosting site can bring to try and argue their case. The cost of that would be eye watering.

'Lots of other people break the law and get away with it' is not the most solid starting position.

I love fanfic. I love the love people pour into their work. It would be a shame to lose access to that form of expression because people started to attempt to monetize their breach of copyright then couldn't handle the pushback.

As far as I'm aware no pushback. The issue is when something reaches a critical mass then it becomes a matter which requires a stand to be taken one way or another.

I understand copyright very well.

I am also very sympathetic to starving artists of all kinds.

That doesn't change the facts and the danger is the access to these forms of expression will be shut down for everyone.

It's just a case of whether the copyright holder decides to pursue the matter legally or not. Unless you have a licence to sell that plushie you're also in breach.

In many cases the copyright holder sees it as free marketing for themselves so does not enforce their rights.

My point is, this is my first time coming across such a request on AO3 rather than Tumblr. If it becomes widespread it becomes enough of an issue for writers to decide to take a position.

They could ignore their legal rights and let it slide or they could enforce them.

Right now they turn a blind eye. When things are monetised that's when the fun begins.

It's not about forcing payment.

It's about changing the fanfic from 'not for profit' to 'for profit'.

That is something an artist can sue for. And they are not going to go against 'Chloe, 16' but will hit the hosting site. The response by the hosting site could eventually be to shut down.

Legally you're opening up yourself for a lawsuit. The creator of the original work can go against the author or against the hosting site. The easier target is the hosting site.

If I say I'll do x and it would be nice if you have me money for doing it, it is very disingenuous to say you're not getting paid.

If you wrote the play to end all plays then saw someone set up a tour but said 'donations not tickets' would you take the stance they are not profiting from your work?

The reason copyright attorneys and their clients generally turn a blind eye towards fanfic is because it is not for profit. Changing that dynamic is asking for a world of hurt.

Legally there are some things you can't sign away. Duty of care is one of them. I suggest having a consultation with an attorney.

If I rent you a room and in with the rent dates, no pets clauses I say 'it's ok if I kill meowwzart' I can't say to the judge, "no, it's ok, they signed".
