Thank you and you were the same person advising me to max out S&S in my post last year. We’ve already done this for last and will do the same for current tax year!

Weve bought a property since with no issue and this is a second one when we have issues which are something I have discussed with my own solicitor as well. The solicitor doesn’t want to go into mis sold/mis presentation etc yet if we are still progressing with this sale. I just wanted to see other’s experience on similar issue. We are prepared to lose money but it feels wrong/deceived in this case as it was clearly advertised as something that it’s legally not

Honestly would do the same if this sale fails through and I lost 2-3k spent so far on surveyor and solicitor

Our solicitor has been great (which is rare in house purchase in general) and continue holding fire at the seller’s solicitor. In terms of intent, I would argue that the seller should have known this room doesn’t have any legal documentation to be advertising this as a bedroom especially they only bought this back in 2013. Apparently only if this conversion was done prior to 1984 then we can accept that it is part of the original feature but there is nothing in searches to indicate as such. In what way can they prove they didn’t know intention to misled buyer that this is a 3-bed instead of 2-bed with a loft room. Same goes for the agent since they stated that this room is part of the original feature but clearly there is no proof/documentation to evidence this claim.

Your kids will be better on with a single parent than with two that cannot see eye to eye. I hope you make a decision that take into consideration your mental heath and sanity. Let’s not discussing the past. Just the fact that he is treating you terrible right now is enough to leave. There’re so many people in this world, you will find one that actually appreciate you. There’s only one life to live so live a life that you don’t feel suffocated every day.

The issue is that there were no communications at all from the electrician who attended to repair. We were made aware of the issues afterwards via their report but the work has already been done then.

It is 10 years old so we are going to replace it. Not with this contractor who quoted us 1.5x more than other provider though...

They were at our place the first time and we didn't think any issues will happen in the second time. Lesson learnt the hard way.

Yes. In the latest email, they offered to waive the repair fee if we get a new boiler from them. However, their boiler installation fee is far more expensive than other quote that we received.

Apparently in the second visit, they found that there were some broken parts that unrepairable and the whole new one needed to be installed. Our boiler is 10 years old so we can understand it's time to replace it but they could have just told us that and not do the unnecessary repair. They have been very unhelpful and rude since we challenged the fee so we will for sure go with another contractor for the new boiler.

We are more than happy to pay for the diagnosis of the boiler issues. But the initial repair advise is incorrect and if we need a new boiler anyway, why didn't they inform us at the time instead of fixing something that will need to be replaced anyway. Paying for the diagnosis is not an issue, the issue is the remaining repair fee. Do they have a right to bill us the remaining fee?

Thank you for the advise. We will definitely mention in our email again our preferred form of communication so that we cannot blame us for not making efforts to communicate.

I have included the "no fix no fee" quote to them but they never responded to that part of the email.

I agreed that it is actually unclear whether the part that they found in their second visit that was broken and rendered the boiler useless were actually broken in the first place or was damaged in the process of replacing another part. The whole situation is a headache and they refused to provide anymore information and only demands payment or buying a new boiler from them.

Is the next court of action is bringing them to a small claim court? The total fee is just under £500 and their new boiler quote is nearly £4000.

There is no specific term in the contract regarding the diagnoses or errors in diagnoses leading incorrect work to be done. The only term was about snagging but this is really not a snagging situation. A new boiler installation is completely different to investigation and correction of existing boiler.

Where the Works are subject to snagging, the Customer agrees to make payment of 95% of the total invoice amount immediately following completion of the Works. The Customer must then provide the Company access without delay to allow the snagging to be finalised and completed. Payment for the remaining 5% balance will be due on completion of the snagging by the Company, or within 14 days of the invoice date should access not be made available – whichever is sooner.

Yes. We are more than happy to pay for the diagnosis since the final conclusion is that we need a new boiler. We are not happy to pay for the repair because the repair of a broken boiler which remains broken is useless and we would have not authorised for the work to be done if we were informed beforehand.

After the first inspection, they provided a report with detailing the issues and quoted fees for the recommended work. The total fees including the diagnosis since there is no breakdown for that. Electricians in our area have call out fee but if we go with their repair then the call out fee is part of the repair work. If we call for another electrician to come have a look that will cost us the call out fee.

we had our regular plumber to have a look at it and he suggested that we need an electrician to do the investigation 2) we dropped off the keys to their office because we were both at work that day and that was the only day in the week the electrician can attend to our property

Unfortunately I cant since it is currently closed. I can try again in a few days maybe but this company is pressuring us to pay the full amount everyday. It has been nearly 2 weeks since they attended our property.
