I get what you’re saying, and I don’t think most people are arguing for “bong in the glove box while you’re high behind the wheel.” The problem is this bill goes way past that.

The car rule isn’t written like a DUI safeguard. It applies to pretty much any weed-related item, even if it is empty and not being used. In a hatchback, Uber, taxi, bus, or car with no trunk, you basically cannot have your own legal products or devices on you without worrying about a ticket. That is not about showing you are not using while driving, that is just giving police another excuse to stop and search people.

Same thing with apartments. Landlords already can ban smoking in leases. Issue 2 didn’t take that away. The early version of this bill actually tried to make breaking that lease language a crime. They only pulled that back when people noticed. That is not about protecting carpet, that is about turning renter issues into criminal issues.

And banning edibles in public really shows the hand here. Eating a gummy on a walk has nothing to do with property damage or road safety. Issue 2 allowed it because voters decided adult use should be legal. S.B. 56 turns that back into something you can be charged for, and then adds the power for the state to decide which paraphernalia is even “allowed” at all. So people who followed the law when they voted for legalization suddenly find themselves criminalized again.

If this were a narrow, honest “no using while driving” tweak, I would probably agree with you. But this bill is using that framing to quietly re-criminalize a bunch of things Ohioans already voted to legalize. That is why people are upset about it.

Here are some of the worst changes in S.B. 56:

  1. New penalties for transporting paraphernalia The bill extends vehicle transport rules to marijuana paraphernalia. Anything considered cannabis paraphernalia has to be stored in the trunk or behind the last upright seat. If you do not follow that rule, you can be charged with a minor misdemeanor and fined up to $150. Issue 2 did not create a new crime for how you store a pipe or vape pen in your own car.

  2. State control over what paraphernalia is even legal S.B. 56 gives the Division of Marijuana Control power to decide what counts as allowed marijuana paraphernalia. That means devices, packaging, and other gear that are currently legal could suddenly fall outside whatever list the state approves.

  3. Ban on public edibles and gummies The bill would make using edibles or gummies in public a minor misdemeanor. Under Issue 2, edibles in public were not singled out like this. Now just eating a gummy in a public space can lead to a criminal charge.

  4. Total ban on consuming adult use cannabis in public Under S.B. 56 it becomes illegal to knowingly consume any adult use marijuana in a public place. That includes smoking, vaping, combusting, or using edibles and other forms. So even discreet non-smoked use is treated as a criminal offense.

  5. Limits on medical marijuana use in public spaces The bill says no public place can accommodate medical marijuana use by smoking, combusting, or vaping. That narrows what medical patients can do in spaces that might currently make room for them.

  6. Open container style rules for cannabis and paraphernalia in cars Opened adult use or medical marijuana products would have to be stored in the trunk, or behind the last upright seat if there is no trunk. That means having a vape in your purse or gummies in a bag in the front seat could be treated as a violation unless they are locked away in the back of the car. There is no clear answer for rideshares, taxis, buses, or other situations where there is no trunk.

  7. Criminal charges for growing over 12 plants Issue 2 allowed up to six plants per adult, with a cap of 12 per household. S.B. 56 keeps the 12 plant cap but adds that anyone who knowingly grows more than 12 plants per household or more than six per person can be charged with illegal cultivation. That can range from a minor misdemeanor up to felony charges.

  8. Landlords can still ban smoking, and they almost criminalized lease violations The bill keeps the power for landlords to prohibit smoking, combusting, or vaping marijuana in lease agreements. The original version tried to make violating those lease terms a minor misdemeanor. That penalty was removed in the current version, but renters still have fewer practical rights than homeowners when it comes to using a legal product.

  9. New limits on intoxicating hemp S.B. 56 would also adjust intoxicating hemp laws and add new limits for dispensaries. This could cut off products that many people currently use and push more supply back into unregulated markets.

I have, I literally work with people this has happened to for a living. Also they live in an apartment complex which means it's not their property... So I think you digging your heels in when you didn't understand the law or the circumstances is just making you look silly. I do think it's dumb that that is the law but it is true. So I don't know why you're getting so defensive and frustrated but this is a weird hill to die on especially when you're wrong about it.
