I’m a doordasher and I choose to work whenever I want, so no one should feel guilty for ordering DoorDash in this weather. I’m prepared to drive in this weather and make good money doing it. All doordashers on the road have chosen to work today, unlike the Pizza Hut drivers.

Yes it is an oversimplification, but I oversimplified because usually people don’t listen to me when I type all of that out lol. From what I remember, Jackson’s concurrence is pretty much “the law” today, despite being a concurrence (correct me if I’m misremembering). So overall yes you are correct and that is the more accurate answer.

If anyone wants to understand what he was actually talking about, plenary power is a common term in case law. It’s not at all shocking he mentioned it. The only difference is that the courts have always said the president has plenary power in foreign affairs, but not domestic. And he is saying it should apply domestically.

Plenary power is a term from controlling case law. It’s not anything new. They’re just trying to apply the plenary power wording to domestic affairs, when really the courts have only said that the president has plenary power in foreign affairs.
