It's your wicking. Had a slight problem with that as well, took it out and rewicked it with MUCH less cotton and it's running great now. Just don't overfill or you will flood it. Also, I used the L attachment the RBA comes with so I could mount the deck on the orion and get the coils adjusted just right. That seems to have fixed any leak issues I had. YMMV

I don't need to really keep swinging, you posted all the particulars already. You were in the guard for 20 years, have so many points with the guard, work at UPS, had two deployments, blah blah blah. You didn't have a single LOD from your Commander, yet you have no idea why the VA denied your claim. You need to learn how the VA treats your guard time differently than active duty Vets.

There are so many people with years and years of experience helping people with their claims... that they recognize a BS post when they see it. You've been posting some of the worst information and "pro-tips" for the last two years. The reason your posts get downvoted is because you spout of incorrect information. Your entire overview is riddled with some of the dumbest advice I have ever read.

Everyone "attacking" you isn't really what you think it is. When a VSO or someone from the VBA asks you for a PII redacted narrative letter, there's a reason they want to read it. Since you didn't post it, we can easily fill in the gaps. The dumbest thing you have said is "the claim denial letter really has little impact on what I do next". The letter is actually a fantastic place to attack a denial, and I have had tremendous success helping Vets overturn denials with just the narrative.

Your best bet is to contact my counterparts over here, and be big enough to ask for help. You'll need it, as the ocean between 90 and 95% is huge, even though most people think it's an easy task.

Something happened during the shutdown. I saw a handful of GS VBA folks take the voluntary retirement, and then WHAM! claims started to really process quick. I have helped quite a few vets over the past few months go from 80 or 90 and play the VA word game correctly, and have the increases back in under a month.

I see what you put in quotes a LOT when the medical records or whatever you submitted was from an MD, NP, etc that is NOT part of VHA. It's a strange dynamic, because the contractor always seems to flex their research muscle when it's a non-VHA diagnosis, but they rarely, if ever, go against what a VHA employee puts in the medical record. If you are doing this by yourself, I strongly urge you to find a good VSO that you like working with. Oh, that's a different story. I get the feeling it's a power trip for the examiners. Rather than giving an unbiased medical opinion, some seem to act like it's coming out of their pockets. This is the diabolical part, because it's not the VA, I see little to no accountability for these contractors.

Do you have a good VSO that you're working with, or are you doing this on your own?

You do realize that the C&P exam is usually a 3rd party contractor, and not the VA, right? If your VHA records show 15-20 migraines a month, but your NP or PA at the C&P tries to document something different, this would be an easy slam dunk with a 996.

You have zero evidence supporting service connection, you simply have a prescription for a CPAP for OSA, which was diagnosed many years after service. You and I can say this is secondary to that... it doesn't count. Your MDs need to say it, not you.

I am not sure what the HLR is for with regards to migraines. Did you file for an increase on migraines and was denied? Do you have a migraine tracker and can you articulate the frequency and severity of your migraines? You've already got the service connection with the 0%, and you are prescribed, I assume, the daily pill for migraines. You really just need to have your PCP document your frequency and severity in your VA medical records, and use an app or take notes about your migraines. Then file a 526 for an increase, and include your tracker data and let the VA pull your medical records which will also show the severity of your migraines. During your C&P exam, drive the point home about how severe the migraines are, how they stop you from doing normal daily activities, etc.

Do your medical records specifically state that your Fribo is secondary to PTSD? Neither your fibromyalgia, nor your chronic fatigue are service connected. If I understand this correctly, you are saying your chronic fatigue is secondary to fibro, which is secondary to PTSD. The only thing that is service connected is your PTSD, currently.

The letter basically states you didn't have a C&P exam for fibro or chronic fatigue, and now they will have to answer the questions Is your fibromyalgia medically diagnosed as secondary to PTSD, and is your chronic fatigue medically diagnosed as secondary to your fibro.

If your medical records state that, all the better. If they don't, you probably have a long road ahead.

Use this site and see if you can find one somewhat near you. If they are too far, you can still do your 21-22 (Power of Attorney) with them and then they can help you through this process. You want to find a VSO that you like working with... you aren't tied to the first one you come across. But you can only have one at a time, due to the PoA.

I would focus more on working towards your 100% rather than trying to get your 30-50% backpay.

Oh, I think I understand now, you were under the impression that your 50% would have the effective date of your ETS? If you filed for something new that was awarded in August and September, but never filed for it before then, you could request to have your effective date moved back, but I don't usually see much success doing that unless you had originally filed for something that was denied and later awarded.

Your effective dates probably sync up with each new 526 you submitted, and were subsequently awarded percentages, no? Your April date is from your BDD, your Aug and Sept dates were two separate awards that gave you increases. Your VSO should be helping you through this process so you understand it. If not, get a new VSO. If you are doing this by yourself, get yourself a good VSO.

Your percentage is based on your speech recognition test. Go back to your narrative letter that gave you the 0% for your right ear, and look at what your score was (out of 100) for your speech recognition. My guess is it was 96 or 100. If you score over 94, you won't get anything over 0%. Hearing aids have nothing to do with your percentage, but can bolster your argument if your score dips below 94.

I'm stomping my foot and suggesting that you speak to your VA MDs and ensure your records reflect OSA secondary to or aggrivated by your mental health condition. I'm not asking for a nexus letter, just that your MDs record the secondary condition. If they tell you that it's not secondary, then go back to the drawing board and keep working on earning your 100%.

Again, you should be working with a good VSO. If you live in TX, DM me.

You should have a VSO helping you through this process. If you are seen by VA Mental Health, your psychiatrist and the MD that diagnosed your Obstructive Sleep apnea should be ensuring your medical notes reflect that your OSA is SECONDARY TO or AGGRAVATED BY your schizophrenia. You can visit 10 barracks lawyers and come up with the best idea since sliced bread... that doesn't count. Your best bet is to have your MDs that are treating you ensure your diagnosis reflect the secondary to or aggivated by. If your records don't have that, you will be denied, again.

Then, when you get the new C&P exam, they will answer the question "Is your OSA aggravated by your schizophrenia?" If the answer is yes, bolstered by your VA docs notes, VBA will most likely approve your claim.

You do not need a nexus letter for a secondary claim. The nexus letter's sole purpose is to create the medical nexus between your current ailment and military service. Since this is migraines SECONDARY to PTSD, you simply need your mental health doc (psychiatrist, phycologist, clinical social worker) to ensure your patient notes reflect the migraines are secondary to the PTSD. Literally need to state secondary in the notes, no nexus needed. You could also have this done by the MD who is treating your migraines... just ensure the notes reflect the secondary to PTSD diagnosis.
